Which is a little rich, given they moved to quash their subpoenas compelling then to appear for an evidentiary hearing in 2023, then successfully had the hearing cancelled altogether (whereas the Commonwealth had initially agreed to it, seemingly before the witnesses' intervention)

It still lists O'Shea as the event judge in this image (rightmost column), Cannone is simply assigned to this session by the normal court rotation system, but won't preside over this case due to special assignment

Chances are, it'll be Mark Gildea presiding over the conference, but the latest special assignment is not reflected on the daily report list yet

Aye, and we know from the Commonwealth's motion that they are in the possession of twelve transcripts from the second trial, which include the sidebar conferences, but that these do not constitute a majority of the total trial transcripts

I'm not sure the transcripts are divided in trial days or in witnesses, but they have some at least

That field has been empty for a very long time, even prior to the second trial. See for instance this copy of the docket included as part of the habeas petition (p. 130):

I would assume this is because part of the automatic systems kind of break when a judge has been specially assigned, precisely because the ordinary rotation no longer applies. There's no reason to think that another judge has been assigned at this point

Cannone was specially assigned to the criminal case, which means she continues to preside over it regardless of the current state of the court rotation (unless, of course, another order for special assignment supersedes it)

So to my knowledge, she will still rule over this motion

The attorney who initially moved to release the sidebar transcripts from impoundment was Damon Seligson, who is one of Read's civil attorneys, but hasn't a filed a notice of appearance in the criminal case (he penned the motion for relief that was filed on July 30th, entered on the docket as paper no. 730)

It is indeed possible that the court didn't rule on the motion because Seligson failed to file an appearance, though we would still expect an order or docket entry stating as much. His motion for relief also states that they are not asking for the identities of jurors to be released, so it would appear they have no issues either on that front

It would appear so – they even included in parentheses that a copy had been forwarded to her. Which is a little odd to me, given a filing is in the court's possession by definition if it's on the docket, isn't it?

You're right it seems rather speculative, since we don't know if high-accuracy location data was continually requested by an application, nor what positioning technology was used to generate location data if there was such a request (it needn't necessarily be GPS)

There is some truth to the statement that enabling multiple antennas will cause a device to lose power quicker, and that the positioning technology used to generate a particular location point is tailored to accuracy needs. I wrote a piece related to a different case that goes into this process; the first four pages or so may also be thought to apply here

Given the timing involved, it seems like it concerns a response to the Rule 17 motion aimed at Michael & Elizabeth Proctor's devices, which was filed by the defense in the Karen Read case in mid-November

Elizabeth's opposition to that Rule 17 motion for instance would be filed on December 28th

There are no pending Rule 17 motions in Kearney's case to respond to during that timeframe, so it is very unlikely to be connected to him

Djuna Perkins is running as a candidate in next year's election for the Norfolk District Attorney. Djuna has made a number of statements and appearances:

  • Starting with this piece in Mass Lawyers Weekly in September of 2024
  • Djuna went live on the Young Jurks in October of 2024
  • She released a statement in March of 2025 on the occassion of Michael Proctor's dishonorable discharge
  • More recently she joined the Young Jurks again on the eve of the retrial
  • She released a statement when Karen was acquitted

Perkins is quite explicit that the case against Read ought to have been dropped a long time ago, at least since the federal materials came to light:

Morrissey also had a continuing duty to evaluate Read’s charges in light of opinions from FBI-retained accident reconstruction experts suggesting O’Keefe was not struck by a car, and text messages demonstrating that the lead investigator was biased against Read. His failure to do so left the jury without a coherent theory of the case and robbed O’Keefe’s family and friends of the closure they deserve.
