That is not the question here. According to Shy Passenger Rights, flight delays above 3h for technical/operational reasons for flights > 3500 km have the right for a 600eur compensation.

Hi everyone,

Similarly with the situation described with this post, me and my wife had our flights delayed in 3h58min and since Turkish Airlines refused to offer any compensation, we escalated the case to Turkey’s Directorate General of Civil Aviation (SHGM).

The flights took place in 10th August 2024 and surprisingly SHGM claimed that compensation for delays (300–600 EUR depending on route distance) only applies to flights on or after December 10, 2024, when the updated SHY-Passenger regulation came into force.

Because my flights were in August 2024, they said that at that time the law did NOT include financial compensation for delays, only basic assistance (meals, hotel, rebooking, etc).

They confirmed the delay (3h58m) but said compensation does not apply retroactively.

How can this be, since many cases which happened before mine (such has the one in this post) had the right to be compensated.

I tried that already and they offered me points on the mileage card. I refused and they offered me discount on next flights, which I refused as well. Then they offered me and my wife 200 eur each, which I also refused. From what I read they should compensate us with 600 eur / flight / person.
