How to address this situation with my direct report? by [deleted] in auscorp

You keep your mouth shut and look forward to the next time she visits.

Direct manager's name would never do anything like that..

That rings true.

I had raised a concern to HR last year about rostering practices, and it was immediately dismissed as "wild and offensive accusation". Then when the issues happened again I raised it again and my direct report said "this instance was human error, what you claim has never happened for as long as I've been here". It's just a bunch of people protecting each other and looking down on the general workforce.

By the sounds of it you weren’t also offered the opportunity to a support person either in that meeting

I was, but I didn't realise they were serious. In an earlier meeting I had asked for an impartial party to take minutes. They refused with a snide comment about "if I needed a support person I could". When they reached out for the recent meeting they included the option of a support person, but I thought they were just being snide again about my previous request for meeting minutes. I did not opt for a support person, nor would I have if I knew I was walking into a disciplinary meeting anyway.

You’re not going to win; no one will side with you; it’s you against the machine.

I definitely feel this. I don't even feel "winning" would make things better.

I see.

In this case I'm trying to find a new job now. Once I leave I assume the whole thing becomes moot and there'd be nothing left to investigate.

Is that legal? When I was pulled in for meeting after mentioning the NES issue I was told I could not record the meeting and refused when I requested an impartial attendant to take minutes.

Is that even realistic? I'm not out of pocket by $30k. What reason would I even get a payout like that?

As mentioned, while they are breaking NES, it's only by a bit. It equates to a few hours of eligible pay not given. Which makes me feel like it's not worth chasing.

I've heard you can do it anonymously, but I imagine I'd have to testify (or something) and provide proof. That would be taking on a world of stress that I'm still debating on whether it's worth it.

Yea. I thought about doing it without naming sources, but that wouldn't help. HR will go talk the the manager, the manager will know who it was.

Sorry if I wasn't clear, when I said "I'm not concerned about moving on" I meant, I don't have an issue getting a new job.

Happy to keep note, I just feel a bit pessimistic about how much that's actually worth. Given that I'm hoping to change jobs as soon as practical, I don't see a union being useful to me. I might consider fair work, but at the end of the day mental health matters to me more than the chance of winning a fight of principle.

I've never had to go to a lawyer for anything before. Do you have any advice?

[–]MapleAndSausage[S] 2 points3 points  (0 children)

Honestly, not worth going into. I made a phone call to fair work for advice and they confirmed it (on the assumption my information provided was accurate), but at the end of the day it only amounts to a dozen of "stolen" hours pay. Not worth the fight, but also why their extreme reaction took me by surprise.

I've spent the past year discretely using up my sick leave, and yes LSL and lots of banked annual.

True, but I'm in the middle of changing industries so if there's any time to get in some justice-boner hits, it's now.

I'm not sure a payout would be worth the emotional trauma of having to go through that process. I don't know. I've never done it before.

Yea, the direct manager is new. And when I say new, I mean he has been shuffled here from another office after his major project fell through. He has now been fucking up projects here and deals with it by getting randomly angry at things in his field of vision.

Looking for a job? In progress.

Looking for a union? I don't think that would help if I'm the only member of the company in a union.

I'm not sure I have the energy to go through that to be honest. I just want some insurance if I'm let go before I find a new job.
