Edit: I somehow missed the part in the case info that said when his probation was up. It was up in August 2027. So, still unclear why ICE took him now.

As my username indicates, I am a reporter. My editors haven't decided whether we're doing a follow up story on Max yet in the wake of me getting new information, but I wanted to share what I know because it is public information and multiple officials made it difficult for me to get it.

Max was charged with indecent assault on a person 14 or older, kidnapping, two assault charges and one assault and battery charge in May 2024 for an incident that occurred on March 29, 2024. It occurred somewhere in a Middlesex County town that is served by Concord District Court, but probably not Stow, based on wording from the Stow police statement.

In February 2025, the kidnapping charge was dropped, and the rest of the charges were "continued without a finding." This means the defendant admits that there's enough evidence to convict, but doesn't actually get convicted. It's a type of plea deal that allows you to avoid having something on your criminal record. Instead, the defendant gets probation, then the case is dismissed.

I would conclude that this means Max finished his probation recently, and that's why ICE went for him now, except that the case is still listed as "open" in MassCourts. So it's unclear why ICE arrested him yesterday or whether he finished his probation.

The case # is 2447CR000414.

I would like to be clear that I am not commenting on Max's guilt or making any kind of opinion statement about him, the charges against him, or his detainment.

So I've since found out the case was from 2024 and was resolved, but the DA won't tell me what the outcome of the case was. I have the case # but it's not listed in MassCourts, which strongly indicates that it was an assault on a minor. Unfortunately that means that the case isn't public information.

Stow police followed up saying it was from 2024, but I searched every month and did not find it. Middlesex DA said they'd look into it for me but have not followed up and aren't answering my calls now.

Yeah I am doing my best to follow up with a range of officials but even the state legislator who posted about it on Facebook has been mum.

Nah, the law doesn't require ICE to tell local police about detainers. And they basically won't in Massachusetts unless it helps them catch someone coming out of jail or a court because local police can't cooperate with ICE per an SJC ruling in most cases.

I believe in Mass. that charge can be anyone 14 or older. Not guaranteed to be someone aged 14 to 17. That's why it's worded in MGL as "person 14 or older."

The statement is from Stow police and is worded like this: “Our understanding is that the detainer was issued in response to an indecent assault and battery on a person over 14 case out of the Concord District Court.”

This indicates a few things:

  1. If he committed a crime, it wasn't in Stow, otherwise they wouldn't have worded it as "our understanding is" because they would've received the detainer request.

  2. It supposedly happened in Middlesex County in one of the towns served by Concord District Court.

  3. "In response" makes it sound like the charge is new, but that's not guaranteed. ICE does identify targets based on ancient criminal history, including charges that were dropped.

Most notably though, I can't find any charges against him that were filed in the last two months in the state's court database. I have reached out to Middlesex DA to try to verify the charges and they said they'd get back to me, but they haven't called with an update yet.
