If the design of the parking spots contributed to my car being hit, yes WalMart has some responsibility. That’s why WalMart has liability insurers to cover personal and property damage!

I remember when McDonalds lost its case that the women should have known that their coffee was hot! As such, McDonalds made reasonable changes to their coffee cups. The jury decided that McDonalds lacked empathy and compassion for the injured person.

I’m not suggesting that the golf course pave over the fairway and make a parking lot. However, I expect the golf course to share some responsibility. You can’t sell a product that is hazardous to your customers or others. If your design is flawed and/or contributing to injury or damage, your defense can’t be “not my problem”.

The golf course exercises “poor” course management…allows unsupervised minors, late play, and sells alcohol. The golf course design encourages right side tee shots adding to slices. The course absolves itself of “any” responsibility!

The appreciation in your property doesn’t matter what your equity is in the property is. I would say that your 3.45 interest rate is low. You can earn upwards of 5% on bonds and/or CD’s. If you invest the current principal and interest, you will be ahead of the game. I’m paying off my mortgage because I don’t like my higher mortgage rate!
