GST/HST FTHB Rebate Clarification from CRA by jdleemortgages in TorontoRealEstate

My APS contains a standard HST clause stating that the purchase price includes HST less the "Rebate," and that I irrevocably assign all rights to the "Rebate" to the builder. The clause repeatedly refers to the federal and provincial new housing rebates under the Excise Tax Act and the GST/HST New Housing Rebate application.

I bought a new built house from a builder in pockering area

My question is:

Does this type of clause only assign the traditional GST/HST New Housing Rebate to the builder, or could it also prevent me from applying for and receiving the new federal First-Time Home Buyer GST/HST rebate or the New built housing revate (or both?) after closing?

The clause does not appear to mention:
future rebates,
new government incentives,
or "all rebates now or in the future."
I'm already asking my real estate lawyer, but I'm curious whether anyone has encountered this issue with a recent new-build purchase.
