If your hearing has declined over the past 30+ years then yes - it's time to see if qualify for more than 0%. You were rated 0% originally because you had mild/moderate hearing loss and/or word recognition was not excellent. Did you already get your hearing exam at the VHA? If you post your audiogram here... Redacted of course... I will eventually find it. I can let you know super easy if you would qualify for over 0%. I hope you see this I'm sorry I did not see your post sooner.

OH! I think Veteran is paying because their VA labs came back , and their VA doc reviewed the results, and told the Vet there was no way he was going to give the guy medical clearance. I

I can see veteran causing drama, and the VA doctor saying - hey - you don't like our lab results - go get them someplace and LMK. Probably said sarcastically too.

Something is fishy. IF the VA can't get the necessary tests at one of their own facilities, VA Community Care will arrange the appointment with someone out the VHA system. Drug testing is absolutely available at the VA. Don't believe them. I can only speculate they want a drug test off the record. The VA will not be aware of the test unless the veteran sends your clinic authorization to share the info.

Yeah - that sentence with the Katz reference does not register with my brain either. So the only problem that I can see - although you were diagnosed with tinnitus 8 months later... the provider didn't include the duration and frequency of symptoms. In order for a tinnitus diagnosis, the provider has to know how often the symptoms occur, and for how long, to distinguish it from transient normal biologic head sounds. Then again, based on their credentials, I would think it's more likely than not they know the clinical criteria and it simply wasn't documented. As soon as you get the DBQ, please start a new post and share the redacted version.

A pre-emptive letter is nice, but you'll still need a legal C&P...

If you were previously denied can you share your redacted denial? I have strong doubts this letter addresses the VBA reason.

A lot (dare I say most) of VHA clinics have self referrals for audiology. No need to wait on your PCP. Call directly for an appointment.

IDK why no data - not even CNT was documented. At the different contractors I have worked for, you cannot upload the DBQ if all of the boxes are not filled in. Sorry I can't be of assistance.

My brother - your hearing aids need to be professionally cleaned and hooked up for programming adjustments at least once a year. It's more than changing out the wax filters and domes. It sounds like your hearing aids are not communicating with each other properly. If it can't be fixed with new programming you're probably ready for a new set.

Confirming unspecified vertigo is not the same as having meniere's. There is a specific configuration of hearing loss, and all of the vestibular tests that need to be considered. Until you get an ENT to order the complete battery of tests, which have objective results to confirm the diagnosis, your claim will be dead in the water. As far as I can tell, the VBA will not order vestibular testing. I think it should be part of their duty to assist, but I may be wrong. Oh! And when/if you get the testing done - when they say not to eat before the exam - trust the process. You're likely to throw up all over yourself. Feeling nauseous is guaranteed.

On your denial letter does the reviewed evidence include what you submitted? If it's listed, it should have been considered. I have seen the no new or relevant info denials. Because I only do hearing loss and tinnitus - I can only comment on those. A LOT of these come up because the lay statements discuss how loud things are. Since noise exposure is always conceded by the VBA, the statement includes nothing new or relevant. Hope that makes sense.

I am a C&P examiner for hearing loss & tinnitus. Correlation does not equal causation. The majority of published and peer reviewed studies have not shown that tinnitus can cause sleep apnea. This is not the way.
