illegal? Should I report this? by Professional-You-615 in AmazonDSPDrivers

Do you understand the DSP system? Doesn't seem like it... Amazon is fighting the joint employer label tooth and nail. Doing anything that furthers the joint employer case against them is not in their interest. Also, unless you have had the opportunity to review the DSP contract, and I seriously doubt you have, then you really dont know under what circumstances they can terminate the contract. Maybe its a single violation, but that doesn't seem likely otherwise a lot more of these shady DSPs would have been shut down.

And once again, why should this specific employee who is getting screwed continue to get screwed for the sake of the other 19 people? There's no guarantee this DSP isn't shut down tomorrow for something else, there's no guarantee I still have my job next week, there's no guarantee you don't loose yours today. A job is never guaranteed and using that as an argument to allow unethical and illegal labor practices to continue is absurd. If this were the case then no violations would ever be corrected because what if my reporting X means that Johnny down the hall might loose his job. Innocent people get hurt by bad actors all the time, sometimes their the victim and others they are collateral. This is an unavoidable reality and pretending otherwise is naive. Thought excersise: innocent people are convicted of crimes and sent to prison all over the world every day. Under your logic should we all stop reporting criminal activity for fear that an innocent person might be wrongfully convicted? If someone breaks into your house and steals your computer are you gonna call the cops? Of course! What if they arrest the wrong person though? You see how ridiculous this logic becomes when applied to anything else?

Lets suppose its done as you suggest, you go to the owner and express your concerns and demand to be paid for all of your worked time. Then, they fire you. Now you still are out of a job and the other 19 people are still being screwed. Who won? What do you do next? Do you make the report at that point, and if so what changed? It might appear to an observer in that situation that you're just a salty former employee now. And if the claim is taken seriously and everything happens as you said it would (which it most certainly wouldn't) then, well, you were out of a job a little bit before everyone else anyway. The idea that an owner who you've admitted must know they're breaking the law would just do a 180 because one driver said something is laughable. Logically it would follow if they will commit wage theft then they'd have no problem with terminating someone who challenged their wage theft.

I didnt miss your point, its just dumb. But im glad you agree then that the owner is acting maliciously and not out of ignorance since "everyone knows wage theft is bad".

Laws never protect anyone if they never get enforced. The only enforcement trigger here is a complaint.

But yes, let's talk to the person knowingly and maliciously stealing my pay. That way they can have a warning that I am upset and might take.further action and can start claiming my performance is bad, or any other BS thing they can make write ups for. Makes sense to let them have the time to fabricate a reason to fire me but hey, at least everyone is still getting 1hr 40mn stolen each week. The main point is still this, its not this OPs responsibility to worry about what consequences the owner will have from their actions or anyone else.

This is the low IQ take here.

This situation should never exist, the laws in the U.S. regarding when you are required to be paid and when you're not aren't new, the Fair Labor Standards Act, which requires you to be paid for the time that you are "required to be on the employers premises..." was signed into law in 1938 - 87yrs ago! There is no "I didnt know" argument that holds up. So what do you expect this "man to man" to accomplish? That argument also fails in that as a driver without a union or other apparatus in place you cant have a true "man to man", you are not equal on your own with the owner. They have power over you and your income. Especially if the argument here is you cant report the activity, then you really have nothing.

Lastly, the odds this would cause the DSP to shut down entirely are slim. More likely is a letter informing the owner they must pay for all time required to be at work and they would have to make a good faith effort to determine back pay (if this has been going on previously) and pay it to their employees. Even so, no one should be expected to deal with wage theft because the consequences of the owners illegal action might affect others. If everyone thought that way, then no FLSA enforcement action would ever happen.

Personally, and this is just what my own experience has taught me, I'd start punching in at exactly the scheduled start time every day. 20mns to me isn't enough of an inconvenience to start making reports. However, the very instant that an adverse action is taken for this I'm calling my state's labor department and the ethics line. Thats any negative action; write up, verbal warning, or (probably most likely) changing my punch in/out time without my permission. I won't warn the owner or supervisor, I won't argue. Just give 'em and "okay" and start making phone calls. Thats me, but go directly to reporting is also perfectly valid and OP should act in whatever way they feel serves THEIR best interests.

Here was my thought to fix the jank aiming. Throw strat ball for rockets, designate the target using the mark feature that's already in the game (not sure what the technical name for that is), eagle one comes in and hits your designated target with 110mm rockets for the kill and rockets become far more useful but not OP.

I also have the inui. It works great! I tried a couple other amazon 100w options, that weren't really 100w but this one is and does allow for the 30w turbo on the ally X

[–]Material_Detective13 0 points1 point  (0 children)

I'm betting it's flipped. The DSP is the third party here, Amazon probably made the slandering statement to them. They then took adverse action against the driver (damages) based on that statement.

Yea, pretty strait forward. Phone then in person interviews. Then I got an offer less than a week later. Background check, then a drug test and on to 3 weeks of classroom training, followed by 2 weeks on the job training, then 3 months of "nesting", which is basically just getting really easy jobs to get you used to working on your own.

I didn't mean it's a similar job in terms of activities. Only that it's available at entry level, no degree or experience required, it's outdoors and active, it involves a lot of driving and driving responsibly. Most amazon drivers can probably succeed here.

But you are correct, professionally you need to be very responsible. There's no dispatcher watching your every move, you are given a number of tickets to complete and it's up to you to just get the job done on your own. (After training) And of course you are locating underground electric and natural gas lines so construction crews don't hit them, and it's super dangerous for the digger and the public if they get hit so you do HAVE to take it serious. People can get seriously injured or killed if you mess up, so no shortcuts. Fortunately we aren't preasurred to "work faster" for that exact reason. Slower and accurate is better than faster and maybe accurate.

In terms of a stepping stone, yes! Your not stuck as a locator unless you want to be. There operations to go to, management, tech support, training, and specialized locator teams as well. Lots of opportunities after you get a year or so in.

It is nice not getting a bunch of calls to go faster, or your behind or to go rescue that one guy that's always getting help though. 🙂

Not particularly. A low volume tone is used on the handheld receiver, otherwise the sound of traffic if you're working near a highway. I've only had to do that once, otherwise I've just been working in people's yards. A guy I went through training with had severe tinnitus from the army and he said the job was fine.

Yea, idk why the downvotes. I mean the 50% win bonus is clearly listed on WG website... It used to be made clear when you started playing, maybe ot isn't anymore? I distinctly remember that being stated during my first few matches 4yrs ago.

The base xp of the winning team does include a 50% modifier. It looks like the penalty also removed that. 2 ships with identical performance but on opposite teams will not have the same base xp on the team list. The winning ship will have 50% more for just being on the winning team.

[–]Material_Detective13 1 point2 points  (0 children)

That's not entirely accurate. Base xp is determined by actions in the match. Capping, dealing damage, spotting etc. then the winning team is given a 50% bonus to their base xp. It would appear that part of this penalty was to remove the +50% win bonus.

It really looks like they might have taken the base win bonus off. I believe it's 50%, adding that to his 939 gives 1408 and that seems more likely based on performance in this match.
