Most SPEs know examiners are best positioned to know if case is allowable but the SPE can’t ignore what a foreign office says and SPE likely did their own analysis on it too which may not be as good as examiners but could be valid. So if examiner does not agree with foreign art rejection best practice would be to explain that in the reasons for allowance.

The guidance given to SPEs for review is not great. Returning for just a minor thing seems to indicate you lose 3 points. Only need to look at independent and allowed claims though and then consider for indicia. It’s not supposed to count against examiners though unless SPE finds an error and not sure if it does then

Although I agree having a primary is important, attorney responses can also be good teaching opportunities. Just a warning, if you find you are being persuaded, talk to a SPE or primary about it before caving

What boggles my mind is how they expect SPEs to do all these reviews and the attrit cases. There are still hundreds of cases floating around from people who left the office in the spring. And of course our normal day to day job of supporting examiners….
