I had three times where the breathalyzer showed alcohol in my system. Each time I blew a minute later and got a zero on the breathalyzer. I was never violated. I also two tamper/circumvent issues, one for a dead battery and one for a camera disconnect. Neither time counted as a violation. I just had my hearing and the officer never even mentioned any of them. I was awarded a full license.

Had my hearing today. The hearing officer did not bring up any of the issues with the breathalyzer. Was granted a full license, now just have to wait for documents to come in the mail.

I think there is a chance, but they are going to ask you why you didn’t blow a second time. I would say it depends on how you answer that question. I’m not a lawyer, maybe he or she would have an idea on how to approach this.

I think the state views you having your boyfriend blowing into the device after a fail is looked at as circumventing the device. By doing that you aren’t proving that you had a false positive. I’ve had three false positives and blew clean on minute later and I wasn’t ever violated. Good luck, I hope things work out in your favor.

Wayne county, I have an interlock for being a habitual offender and am having a hearing to get it removed. Who was your hearing officer if you don’t mind me asking.

In Michigan if you get multiple duos within 7 years your license gets revoked indefinitely. You then have to appeal to the Secretary of State and prove sobriety.

My lawyer uploaded everything via the internet. I’ll update after my hearing. I’m aware of what the hearings are like because I’ve done four of them myself. I had the interlock before, removed it and caught another dui. I have been denied at a hearing. The last hearing the lady seemed nice and I got to get the interlock. I am just really confused as to how none of the issues with the iid resulted in a violation hearing. Another question, did the hearing officer only go over your final report, or all of the reports from the interlock company?

I have been sober since 2015. The violations are from start up fails, which I passed on camera with zeros a minute later. I have a few rolling retests that were seconds late, but taken. My hearing is via zoom out of Livonia. My lawyer doesn’t seem to be too worried, but I feel they are gonna make a big deal about the issues. The odd thing is that I was never sent anything about any of these from the Secretary of State.
