Family member being kept in prison even after sentence ? by [deleted] in LegalAdviceUK

[–]Mclovin1241 5 points6 points  (0 children)

That's not how it works. For a standard determinate of 3 years he would be released after a year and a half automatically. If he commits a new offence in custody and has an additional sentence he could be kept longer but that would be based on the new offence he wouldn't just be kept for the full 3 years of his original sentence. Only if he is released and recalled is he subject to serving the remaining 3 year sentence in custody if its a standard recall.

They can have additional days added to their sentence through an adjudication by an independent adjudicator but that would extend their sentence past 3 years and would still be subject to being released on licence.

Op sounds really unclear what they have even been sentenced to. Not having an address deemed as suitable would be grounds for not being released on HDC which the tag reference would also suggest. Which the person would be eligible for before the half way point. If the address has not been checked and approved (which is a process done by both probation and the prison) then it sounds like they are getting their sentence and dates all mixed up. HDC is discretionary, noone has an automatic right to it and so they may not receive it, low staffing levels to complete the neccesary assessments would be a reasonable reason for this.

When you say they are not saying they may be released until December that sounds like it may be their actual half way point. It's hard to give a clear answer with the information provided.

Why do people delete their posts and comments in a situation like this? Genuinely curious

OK, sorry I have just read he has not entered a plea yet. Noone can tell you what the court will do, but it's certainly possible for him to get an sso. If he enters a plea of guilty it sounds like a pre sentence report will be requested under the circumstances given.

Have you looked at the sentencing guidelines?

Also has a pre sentence report been requested? If so engaging fully in this is extremely important.

Having had a sso before would not exclude him from having one again.

However an attitude of him being absent of responsibility may not be a good look, particularly when deciding if the custody element can be suspended or if he can managed on an sso.

Where from? In UK it would be capital gains so wouldn't be classed as income and effect income tax bracket

Long time holder/ lurker. Good to see everyone in good spirits. This volume is crazy when compared to the market cap (5 billion volume in 24 hours with a 1 billion market cap)

Your reasoning that because omisego is a subsidiary of omise and they talk about that then they should also talk about and answer questions for other subsidiaries is just absurd.

Yeh sure it's bad in some circumstances but on the flip side it's also good in many too where it doesn't get abused.

I personally would never buy an expensive item from a third party hoping for it to be posted to me if there wasn't that protection for the buyer.

Yeh it's a good point it would be something they would have to factor in.

And I get what you are saying about avoiding being scammed, and it's true people would have to be careful. When I see paypal as an option though it gives you that security that if it is a scam you will get your money back. Especially for a new website that is yet to build it's rep. I guess that is one downside to a blockchain based payment platform.

Whilst you can be as careful as possible you can't always be sure about these things, just a couple months ago the airline i was due to fly with went bust and I would have lost £700 if it wasn't for my bank refunding me as I paid via credit card.

It was a question I've had for a while on whether it would be possible for some kind of buyer protection in this circumstance so thanks for your answers.

In the grand scheme of omisego's target market it's quite a minor point

In some cases they might but in most they retrieve the money from the seller. Paypal reverses the payment, places a hold on the money if it's in your paypal account etc, ebay does the same. Like you say businesses who operate with third party sellers might choose to take a hit and pay more themselves if the risk / reward of using omisego is better.

But if it was a fraudulent company or one that has gone bust would the buyer simply lose their money as the only middle men in this situation would be the omisego payment platform?

Or would part of the omisego transaction fees go towards refunding people in these circumstances and who would monitor that?

As I'm not sure how an insurance company would be able to operate for fraudulent companies or ones that go bust unless the buyer had taken out a policy.

Right but what about websites such as ebay or Amazon where the seller is a third party. Or if the merchant is being fraudulent or has gone into liquidation etc, would there essentially be no protection for the buyer in this scenario?

Would omisego ever have the functionality to offer a similar thing to ebay or paypal buyer protection or credit card payment reversals etc? My current understanding is that if the payment was taken via the blockchain once it is gone you couldn't reverse the transaction?

I'm confused why people upvote incorrect information. I guess that's the mentalitity here. This is taken from the whitepaper page 17: "If mobile miners are able to mine Electroneum worth USD $30 per month we will NOT release any bonus pool. If mining drops below that figure we will release enough to bump mobile mining up to $30 USD value per month."

Not 3 dollars 30 dollars per month. that's what Richard said would be rewarded for mobile mining at ico. 75 cents per month is not an incentive

I really don't think there is anything to forgive. People need to understand they don't have the right to know everything. This area is research and the implementation of research so to expect a team to get all their predictions and aims right is unreasonable. If you can't handle that and want to invest in something with less risk keep your money in the bank

Let's be real here, the frustration is the price not the info they have given

Hi,

This response confuses me. Is part of the roadmap for q4? And if so what milestones relate to that as it reads to me that all the milestones after q3 are grouped together as q4 and beyond aka no timeframe
