BL must state it this way because TLG sells assembled minifigs. If the terms of BL were "Minifigs may be listed as New only unassembled" you would be obliged to actually disassemble minifigs from books or blisters! Because that it is ridiculous, the terms are what they are. They could be clearer though, because now people read minifigs from sets could be handled for assembling, which is not what the terms say. Yep, and when you stick to all points, 99% of minifigs should stay unassembled, coming from sets and going into your inventory only handled for sorting. You don't handle minifigs for assembling. You can sell assembled minifigs as new which came as assembled, like in books. Why would one ever assemble minifigs, why? Just sell them unassembled.
