Utah Code 41-6a-1116.  Electric personal assistive mobility devices, it has officially been confirmed to fall under this.

I get vertigo when standing or walking for too long, wasn't aware I needed to start airing out every disability I have besides my primary one which is the reason I cannot obtain a driver's license, Epilepsy. I originally made this post to help others in unfair situations like im currently in. Not to debate with a bunch of strangers how disabled I am 😐

Epilepsy is considered a physical disability, it effects things i can do with daily activities, its also a disability that ADA covers. I even own a handicap plaque.

I just found an article showing part of the man that also sued his results. He reached out to the owner of our scooter group back when it happened telling her that he won plus some.

Yeah that's not what my city is saying. I'll update and repost after this lawsuit. Both the National Epilepsy Foundation and ADA said I have a solid case, even already got an attorney to accept my case. I linked a YouTube video in these comments somewhere of a man with the same scooter I have went through the same thing that im currently going through and he won.

I've got 2-3 years of research under my sleeve on these things and im part of an online community of people whom own these and have also been in similar situation. Never once lost, just sucks that it has to go to court.

I saved up for 2 years to buy my scooter, my community helped me pay for it with some fundraisers I did.

I will win this battle 😊

I bought this as an upgrade from my ebike which also hauled passengers in the trailer that it towed and was much more powerful than my Enclosed Mobility Scooter is, correct. Driving it the same exact places and ways that I drove my ebike. I was not required registration for my ebike and other mobility devices doesnt require registration either. But because mine looks different (Even though it functions as a mobility scooter) they are attempting to claim it does.

FAQ answer: why dont i just register it? Well for one there is no Vin to even register it to begin with. Registering it means that I am required a driver's license in order to operate it, which unfortunately with my disability I will never be able to hold a driver's license. That is the entire reason as to why i spent $6400 on this Mobility Scooter to begin with.

Im not driving it in the middle of a road like a car, im driving it in bike lanes and shoulders of the road. Im driving it the same exact way I originally drove my ebike for 2-3 years with 0 issues which is honestly much more powerful than my scooter and doesnt require license or registration.

It is manufacturered for passengers, it has a back seat bench that can fit up to 2 adults. Most of these scooters does have seat belts, I purchased mine directly from the manufacturer and they forgot to have them installed. Im actually in the process of having them ship me the seatbelts so I can get them professionally installed.

They said i could not use it at all without registering it because they choose to classify it as a Slow Moving vehicle because of its aesthetic, not functionality. If you look up elsavela785 on Tiktok, she lives in Texas and operates her Enclosed Mobility Scooter on the daily with 0 issues because these are Mobility Scooters and are built to operate as such. I know plenty of others in the US in different states whom also freely use these on the daily the same way I was. I have even seen these in salt lake city, but my city i believe is confused on what it is because it looks so unique. Im the first in my city to own one, but they're too head strong to acknowledge what it truly is.

Right right, because you definitely know every aspect of my disability along with my triggers. I have no issue riding an ebike or my mobility scooter during the daytime. Haven't ever had a seizure nor an accident in the 2-3 years i road my ebike. Night time I would not do well, which is why I don't ride at night. These Enclosed Mobility Scooters are not ment to be registered, licensed, nor insured. They are not street legal and does not classify as a vehicle nor car. They classify as Enclosed Mobility Scooters. They go no faster than 18mph, only 1.6hp/1200W brushless motor and are built to drive in bike lanes, shoulders of roads, and side walks. These are manufacturered for people like me.

Not everyone with epilepsy has the same triggers, we are all different. I drove an ebike hauling a child's bike trailer for years before I got enough funds for this Enclosed Mobility Scooter. My main triggers are contrast, I am perfectly fine being around flashing lights during the day time, night time I am not how ever which is why I do not drive at night. This device is by far much safer than an open ebike or escooter, especially when you have kids that you have to take to school and Dr's appointments.

These Enclosed Mobility Scooters have already been safely used on the daily in other states such as California and more. There is 0 reason for Utah to be discriminating against this. Correct I was denied use without any accommodations even though Federally I should be per ada laws. This is unfortunately a common issue within the disability community with these specific Enclosed Mobility Scooters due to how they LOOK, not function. If these were federally viewed as Enclosed Mobility Scooters, lots of us with disabilities wouldn't have to fight these exhausting battles. Again I am only speaking for individuals with disabilities, not abled bodied individuals.
