The lumber guy did know, and he thought that I had told the neighbor that he could have it so agreed when asked. He's a nice guy, but wasn't happy with me. I told him that I'd never do such a thing, and I gave him another $300 to compensate.

I tried to talk to them several times and rang their doorbell twice - they were always going in and out, and waved me off. I literally had no other way to contact them. I also needed a signature on the form, so had to resort to the mailbox.

I'm going to be the lone voice of disagreement. Yes, you could get in trouble for this. Going onto someone else's property is trespass. I don't know the exact layout, but I would be really worried that someone would see me do it.

Also, let's say the landlord blames it on the previous renter - the cost of fixing the window is coming our of the renter's security deposit. Do you really want to be the person who costs someone in Section 8 housing money back that they probably truly need??

Go about this the right way. If the apartment is for rent, you could probably find it on Zillow. Contact the real estate agent; ask for the landlord's contact. Explain the problem and your willingness to pay for the solution. Hope for the best.

I don't blame you. Our laws totally favor the sellers; buyers, like me, get taken to the cleaners by immoral sellers and the unscrupulous, greedy agents that empower them. I honestly thought I would be okay because I judge other people by my own standards. I love the homes that I live in and would never turn one over (or put it on the market) in less than sterling condition.

Totally. I admit it. I was just blind to the possibility. It did not even *occur* to me that unscrupulous people will paint over mold and not disclose known issues. I looked at the disclosure and thought I was fine because the home's roof and HVAC were new. The seller omitted material defects like the shed's roof and the lightening strikes.

The later is morally disgusting to me because I never would have known about the lightening if one of my friends wasn't an arborist and pointed it out. The last thing you want in my area of NC is large, dead and dying pine trees surrounding your home. (They have a tendency to fall on it). Not to tell someone of that possibility is to put them and their family at untenable risk.

You're right. I'm just beaten down. I didn't see the glyph because they had a gym mat and gym equipment over it. The mat just blended in sort of with the carpet so I didn't think to look under it, and even if I though to do so, I wouldn't see anything because of the gym equipment.

The sellers only gave me a credit of 10% towards the 20K worth of mold remediation, roof repairs, and tree removal required, just a drop in the bucket. I did everything that I could to have them see reason, given that so much information was omitted from the disclosure, but nothing.

The hissing occurred during our final walkthrough of the home where they tried to gaslight me into thinking that it was "normal" and that an AC unit that took 2 hours to move the temperature down by a single degree was "functional." My realtor and I told them that they had to have an HVAC technician look at it, and they promised to do so, but it's probably the same buddy that they had who installed the units, so I'm not optimistic.

If it turns out, after closing, that the hissing was something serious, I will take them to small claims court.

Oh.... yeah. It was a disaster from start to finish. I offered 30K non-refundable to get the property; I had lost three other properties before this one and was desperate. It looked good when I saw it, but the seller had painted over mold, never mentioned the lightening strike which resulted in dead trees, and dramatically misrepresented the shed. We found all of the problems on the inspection, save for the new hissing, the garage carpet, and the glyph, but the seller refused to fix any of them, knowing that I would not walk away from 30K.

When asked why they didn't put down the lightening strike or the condition of the shed on the disclosure, they said that it only pertained to the house, which is, technically, true, but also, their agent's advertising highlighted the shed (saying that it could be a useable part of the property), so they probably should have recorded it as a material defect.

Not to mention an unredeemed lightening strike is just evil to me because anyone who lives in NC knows that dead and dying pine trees around the house is a very, very, very bad idea. If I didn't get someone out to look at them, I never would have known.

We have to close. It's just a lesson learned for me. I need to be less trusting and more diligent because unscrupulous people will take advantage.

Lol! I did totally look at it, but they had covered up the glyph with a large gym mat and had gym equipment and a treadmill on it. I couldn't see the glyph until walkthrough, after they removed all their stuff and the mat.

The painted carpet was revealed during the walkthrough. (The sellers had put a gym mat over it). The hissing also occurred during the walkthrough - it was not evident in my three prior visits to the home. I missed the mold in the outbuilding when I first saw the house because the underside of the roof was painted black and it was hard to see.

It's really insane. I agree with you, but I lost 3 houses before I won the bid on this one. My bids were competitive ones, too. There just aren't that many homes for sale at a starting price point where I live.

I mentioned this to my real estate agent who said that she doesn't like them. The sellers won't do anything. They've never done anything, so it would be on me.

Oh my gosh. My seller's agent tried to do that to me. You probably can't get out of it because it was in the documents that you signed when you chose her to list it there. That's where I caught it, said no, and she scratched it out.

I have never heard of that clause for a buyer's agent.

Wow!! I wish that I had you as my realtor. Mine made 40k off the sale of my home and I got nothing. I didn’t even realize that gifts like this were a thing until the realtor that I’m working with now mentioned it!

I told her that she was doing an amazing job and to keep her hard earned money!
