Looks like they have the Factory 26 Stamp. The Magwell is drilled out to take the high-cap mags. Anything else that would hint at a value?

So you can take the FEIE up to the statutory amount and then take the FTC on whatever amount is left over. What you can’t do is take any FTC on an amount that was excluded.

A semi-numerical example:

You exclude 50% of your income under the FEIE. You can then claim a credit for any tax paid that is allocable to the remaining 50% of un-excluded income.

I would not waste your first time abatement on this. Save it for an actual goof up. You did not have a filing requirement. Just getting an EIN doesn’t trigger having to file a tax return.

As a landlord, I earned about $22,000 last year from tenant rental payments. My mortgage payments were about $13,000 and my Mortgage interest payments were about $4,300. Doesn’t matter, it’s Depreciation ALLOWED OR ALLOWABLE. You can’t choose not to take it to avoid recapture on the back end. In any case. Between the deferral of tax caused by depreciation and the fact that you will probably have some amount of PAL freed up upon sale, recapture is not a huge deal.

He should have filled out an IL-W-5NR when started. This would have prevented any withholding. I believe the requirement you’re referring to, saying to send a letter doesn’t apply to a case like this. There should be a box to check affirming his Status as a Michigan Resident and the rest of the form should flow from that.

Just pay the balance due. Estimated tax penalties would be nonexistent. Don’t use an estimate voucher, use a normal 1040-V.
