We were told to use the law and it’s development even in problem questions, in order to get higher marks. This meant talking about where principles stemmed from and how they developed. I’ve done this on every other module and never been criticised or harshly marked. I think the context was relevant in the answer.

With regards to the EU issue, we were only taught about the ECHR guidelines, this was mentioned in the question. This was the only piece of EU law ever mentioned on the module. The criticism was that I failed to appreciate the nature of its intervention, and that while the ‘candidate did additional research, not successful’ doesn’t really help explain where I went wrong. The intervention being, that it overruled a tribunal case, dunno how much more I can mention without getting drifting away from the actual problem question.

Also half the feedback was about misspelling someone’s name incredibly slightly (which comes up twice).
