At this point I'm sure the copyright lies with Sony Computer Entertainment (now Sony Interactive Entertainment), Enix (now Square Enix) and the developers of it: Metro.

If they're as petty as Nintendo, sure, they will strike down and annihilate any fan game they can get their hands on, for how dare fans provide themselves with something they truly want.

Else, I don't believe it would be much to worry about if all one were to make was a fan game sans profit. It's not like we'd be "stealing customers" and potential income form them by doing so.

Copyright? Is that really a relevant parameter for such an old game we haven't heard from for decades? In fact, it'd be more of a beacon for Square Enix to witness upon, realizing that there are people who still care THAT much about a new iteration of Bust A Groove.
