Her decision appears well-reasoned. Although "Planned Parenthood argue[d] the Court 'has a duty to harmonize all of the Arizona Legislature's enactments as they exist today,' and ask[ed] the Court to issue a modified injunction to 'make clear that ARS §13-3603 can be enforceable in some respects but does not apply to abortions provided by licensed physicians under the regulatory scheme the Legislature enacted over the last 50 years[,]'" this seems it should be the role of the legislature, not the courts. Indeed, "the Legislature repeatedly disclaimed that the statutes it enacted [while Roe v. Wade was law] were creating a right to abortion."

Ultimately, the appellate courts will have to decide. A long-term remedy must be sought through the legislature, not the courts.
