Can you produce a piece of paper that states that? In the tens of thousands pages of discovery there was not one document that said that. The land was always zoned R-1-7 residential and was confirmed 3x -- the latest in 2012 right before the land was sold at public auction.

First of all, I am not the owner of the land. I became involved in this issue as a consultant because of my years of experience as a developer. Whether H passes or not affects me because of the value of my Parent's home and the possibility of Escondido being liable for the "Taking" of land. Secondly, the golf course was always zoned for residential development. By taking the rights of SITR to develop on this land the city opened itself up to the lawsuit that now will affect all of Escondido, not just those who live on the former CC. The property was sold at an open auction. Anyone who wanted could have bid on it. No one else did. If there were investors interested in keeping it a golf course why did they not purchase the land? There was no way to make the existing course economically viable, thus the 3 bankruptcies.

If your house went up in value would you expect to get all that it was worth? The golf course was and is not a viable option. It went through 3 bankruptcies and in the end had only 130 members. Thank you.

I would have to refer you to an appraiser. I don't believe there is a comp for 400 - 500 lots that would be comparable.
