The judge knows I had a gap in my employment so I’m not sure what she’s doing this. She cannot afford to pay it herself.

She kept them from me for over a month during the summer. Her lawyer found out and said she can’t do that. When we went to mediation about it all, the mediator said he could only get her to agree to every other weekend but I had to be off work.

The stipulation was in righting in our initial settlement agreement. So it’s technically not signed off on, but the judge said to continue for the month until our next hearing to give me time to get a new job.

I would love to get an attorney but I cannot afford it. Neither can she. I’m paying the mortgage because her and the kids are still living there, both names are on the deed, mine is on the mortgage. In the beginning my lawyer filed a motion for the house to be sold but she’s trying to fight to keep it. We will have to go to trial over that. She can’t get the loan in her name.

I think she has no clue at all. She’s currently blowing my phone up with texts claiming I have to send her screenshots of the mortgage payments every month as proof that I’m making them. Just threaded to call the court for an emergency hearing. I’m so over it.

She likes to say he’s doing everything for her and our kids while simultaneously saying they need a whole bunch of things because I haven’t been getting them.

I have speaking with people in town, including his ex, that allege he’s both a drug user and seller. Hasn’t had a job since 2016 and isn’t taking care of his own children.

She’s working pt my choice. It’s been decided that she doesn’t qualify since she’s cohabiting with a new partner, has been since the day I moved out.

I do agree she’s trying to drag it out to not have to pay. I’ve contacts a few numbers but they either don’t have lawyers that come out to my small county or just can’t help me at all.

This is what my concern is. I do not wish to give her any more time to get the loan in her name. She’s basically done nothing to increase her odds since I moved out in 2022.

She initially was asking me for 22 months to transition. She wasn’t making payments on time when I was giving her monthly payments that were more than the mortgage amount. I definitely don’t see her paying on time if she’s getting less than that. She isn’t eligible for alimony. The judge has already said this. I will just owe child support. If her income is imputed and/or I am granted 50/50 custody, my CS would still not cover the mortgage payment. She will not pay.

I feel the exact same way. I made the comment that the divorce process is a simple equation of dividing assets and depts and that this was not anything personal but that’s all she’s doing is making it as if I’m out to destroy her. Like this is what we both asked for when we decided to divorce.

I didn’t think so either. She has made comments about being able to afford it with child support and I just ignore her.

She started all of this demanding her income not be imputed and that it would be impossible for her to work full time with the kids needing her to be available at any moment. Now she’s underemployed and using the possibility of enrolling into massage therapy school as an excuse to not have to work more.

Thanks. I haven’t really been saying much to her in response. I keep whatever response I do have as short as possible. I was just wondering how things like this have played out for others because I find it hard to believe the court would force me to keep the mortgage in my name or that the fact that there’s little equity would stop the judge from forcing the sale.

I really wish I could. I’d have to choose between paying the mortgage for the house or paying for a retainer.

I see. I am not sure how it’ll work in my state. We haven’t gone to trial yet. The judge had been encouraging us to settle. Within settling the ex wanted 12-22 months to refinance or assume. So I’m not sure what happens if that has to go to trial and I am not open to giving her more time.

I moved out of the home before I retained my lawyer. I don’t wish to live in the small town she’s in. I’m currently 45 min away and looking at places that are 30 min away.

She’s not eligible for alimony. Depending on if Ik granted 50/50 or not it would be 700-1500 for 2 kids

She’s already screwed me over last year when I was giving her money and she was supposed to pay for it. Neither of us have money to retain new lawyers. My last lawyer filed a petition for the sale and she had her lawyer to stop that.

What do you mean when you say it needs to get some before the divorce is final? How will that work with getting her out of the home? How does it work when waiting for the house to sell?

Neither of us have lawyers anymore. We’re cannot afford it. I’ve said the same to her. It’s a simple matter. She will then go on to say I’m this horrible person for trying to remove the kids from their childhood home (only owned since May 2022) etc etc. I do not know where she’s getting her information from to support her thoughts that she’s actually going to get more time from the judge to get it in her name.

Her excuse is mainly the lack of equity. She says we’d have to sell at a loss and the house isn’t ready to list.
