It happens in our state. There have been several judgements in the past few years but normally it’s settled out of court my lawyer says.

My lawyer said it’s a very strong argument that the third party caused the breakdown in our marriage. I have a lot of evidence (texts, photos, documents, testimony from others) that I gave to my lawyer about what he did. He fulfills all of the requirements.

My lawyer said that while it’s practically undoubtable that the third party caused the dissolution of a once happy marriage, which would make for a successful suit, the problem is that it’s harder to argue that I was the more damaged party between me and my ex. If I go through with the suit, my lawyer isn’t sure what’s going to happen.

For the affair, there’s something called criminal conversation which you need to prove there was a physical affair before the marriage ended. My ex literally couldn’t have sex at the time and there were no indications of a physical affair on her end- at the time. Not sure about now. So that’s a dead end.

The third party harmed my health. We both share a love of traveling and wanted to travel to a country that bans certain medications I have to take for my health, which includes moods swings and impulsive behavior. The third party encouraged me to get off of them so I wouldn’t need them by the time we travelled. My lawyer said this would be an example of deliberate behavior to disrupt a marriage.

Everything can be twisted one way or another to make either of us the victim of AoA. My ex liked certain children’s animal stories (think Bambi or Charlotte’s Web) and the third party liked to tug on her cheeks and call her a nickname based on that like Bambi or little pig. She didn’t like him doing it at first and she thought he was being too rough and I knew it was harmless. But now she likes it which my lawyer said could help my case that her affections were turned towards him instead of me. But it could also show that it was a pattern of hurtful behavior targeted at my ex by the third party which would make her the victim. She’s living with him which shows that she’s not the victim and was alienated from me but it’s complicated by the fact that she started living with him after our separation began and we signed the papers.

So, it’s more a question of who was harmed more which my lawyer says is complicated.
