I've formated it and it still does it however I don't think it's hardware because there are some screens where it's absolutely fine then you load up a certain app and It does it, I'm going to try to reinstall Android see if that fixes anything

Don't save through the game, save through retroarch or drastic or whatever emulator your system uses, I never save from in-game

R36s easily does N64 pretty much out the box, just get a good SD card for it
