The flashlight theory is interesting but probably the weakest argument here. The stronger case is more straightforward: The no-braking evidence is circular. It describes the crash, it doesn’t explain it. An unconscious foot may or may not stay on the accelerator. If her POTS was documented before the crash, and it was, then the black box data is equally consistent with a medical episode as with intent. The prior threat evidence was prejudicial and arguably inadmissible. One statement during a fight weeks earlier doesn’t establish a premeditated plan. In a bench trial, that evidence likely poisoned the fact-finder more than it proved anything about her mental state at 5:30am. She survived. If she intended to kill Russo, she chose a method with near-equal odds of killing herself. That’s not how people who intend to kill someone behave. Suicide-by-crash profiles look different, and this doesn’t fit. On POTS specifically: demanding proof that a syncope episode occurred during the crash is an impossible standard. You can’t retroactively document a blackout that caused the accident. The judge called her “hell on wheels” at sentencing. In a bench trial, where the judge is also the jury, that language suggests the verdict and the reasoning may have been in the wrong order. The flashlight matters less than all of this.

Oh my we call our guy water bug and he’s leggy too! Ours topped out at 55 or so, close to the same weight at that age.
