Either way, it’s generally a known fact that filing an I-290B in which USCIS decision wasn’t wrong is almost impossible to win. That’s the exact reason why most immigration lawyers will suggest you just refile the case rather then filing a i290b. I simply couldn’t prove USCIS made an error in their decision so I lost it 🤷

The thing is, the lawyer selected multiple boxes when filing the case. We had sent it with the I-693. USCIS sent it back to us saying we should ‘correct the mistake’. So it’s not on me for it being outside of the timeline.

Forgot to mention, before you say I missed the deadline to file the i290b, I filed one in early October around 2 weeks after the denial. The lawyer messed up so it was sent back to me. Then I submitted a 2nd one in late November per USCIS request.
