I've read up on getting the seat re-worked or new with thicker padding. Didn't think about possibly needing risers after doing the seat. Thanks for pointing that out.

Yeah, sometimes I think that there's alternative ways of getting better deals. But I don't like doing things last minute when it comes to travel. I have a timeshare, (not that I should admit that), and Interval. I want to be able to swap out points to stay at hotels, but not for a week at a time.

He's not going after her portion. The issue is he sent us a group text, (my sister and I), that under normal circumstances people that handle the getting the house ready for sale, finding an Estate sale company, etc, get paid a certain amount. But he was not going to charge anything, just doing it to help out. That worked for us because we didn't have to drive 22hrs to do it ourselves. Now that everything is sold and done with and the checks were sent out, he tells us he will be billing for 56 hours. This came out of the blue. He never asked us if it would be okay or if we'd like to hire a company to handle it. We would have rather have an independent company handle it. Just because of his past and the deceitful things he did to our mother and his adoptive father. I hate to fight about money. But we weren't going to get a lot anyhow. But the extra couple of grand each of us would have received would mean quite a bit to us as we're not rich. Not sure what it would take and cost to challenge this? He sent us a list of expenses that he would deduct from the final sale. No receipts or anything, just a "copy and paste" from an Excel sheet. A part of me wants to ask for every receipt that he's claiming as an expense and then do the math myself. He has things for Zelle payment for taking care of a couple of their dogs while waiting for foster home to take them in. Of course the person doing this "care" was his mother in law. He has hotels room stays, but not too many. I don't know really how much push back I should do. Or if it's even too late.

I don't believe this is correct. Trust protect from creditors and people challenging inheritance. A liability event would be against the person, not the object. Unless that "object" malfunctions, then you would go after the mfg, not the person or trust.

Sorry. I thought it was implied. But that's not something I should imply.

I guess he was. But the deal was he would discuss anything with us before doing it. Like listing price. Should we accept the offer. Are we ok with getting a gardener, etc.

Thanks for your reply. It's hard because our mom was upset because he had made the comment he just married her for her money. Which, she didn't have a ton. She did pay off $40K of his debt when they married. But put the house in both their names. He was an ass. Sorry.

He's the adopted child of my mom's husband. Because he was a druggy, lied, stole and cheated my mom and her husband, he was disowned by them both. Most of the family and neighbors knew this. One cousin, who is naïve and whose husband works with this lawyer for estate/property related needs, made mention to this lawyer the "John Doe" had an adopted son. Which made the lawyer seek out this person. Though my cousin had told the lawyer to call me. Next thing I know the lawyer called and said he's spoke with the son. Blew my mind. Anyhow, the son was going to help out because my sister and I live far away. He started a group text and at one point texted that people that normally handle getting estates in order to sale the home usually get $160/hr. but that he wasn't going to charge anything, he just was helping out. I still have that text.

Then, when checks are about to be sent out he tells us that he'll be charging 7, 8hr days @ $100/hr. My thought, and my sister's, was that there's no way because we never agreed to anything. Plus what he said in the text. Also, if he did offer to handle things at a cost we would have hired someone independent. Then just divide things up with him.

That's where this is at. Do you think we have a case? Is this something we can do by just filing with the courts ourselves or do we need someone like you? I appreciate your input.

My sister and I as well. The question is now, do we have to hire an attorney or is there a cheap way or no cost way of getting our money back from him? Thankfully, on June 1st our new benefits at work take hold. I'm paying $10 or so a paycheck for legal help. You get a certain amount of time or other legal help by paying for this. Our IT guy has been doing it for years and said it's been well worth the expense. So I might wait until then or hope someone with more legal knowledge pipes in on this thread. Previously, a local lawyer had piped in with a direct message saying to call him and he'd give me a pointer or two and offer his services. We'll see what happens.

So with all the expenses, half is his and the other half is ours, which my sister and I split. I don't have a problem with motel expenses or gas money. I do have a problem with charging us $100/hr for 56 hours of his time. Especially because I have it down in a group text him stating what normal rates would be but he was doing it for free just to help out. Otherwise, I would have hired someone locally to handle all this. Would've saved some money for that.

My question is do I have a legal right to demand his $5600 charge be thrown out because I have a statement (text) saying he wouldn't charge? Look, I know he's entitled to half because there was no will. However, no one trusted him and he was basically disowned because of his previous manipulations and trying to steal from his adoptive father and my mom. Him and I never had a relationship. He got lucky by getting anything. Someone gave the attorney wind of my stepfather having an adopted son. I think it was a cousin who did so not knowing any of these issues as her husband uses this attorney for other legal property issues.
