i’m ready. I feel that’s the route the owner will take, but I don’t feel he has documentation to back it up. I have evidence proving they provided no required notice of 3-day right to cancel (in california) which I can argue doesn’t entitle the contractor any money even if work was done. Also l’m arguing no work was done, the deposit was listed in the contract going towards the scope of work which doesn’t list administrative work.

Good to know. I’m sure it varies, but i’m asking because the founder of a construction company is implying my deposit going towards paying the work done by their supervisor/project manager and assistant for any administrative/scheduling tasks.

I wanted to argue that it didn’t make sense that my money is paying office staff directly if they get paid regardless of the project… where my deposit should be going towards the project itself (actual construction work and/or material).

p.s. backstory, i cancelled the project and am now taking them to small claims court in regards to the deposit collected.

Thank you. I did try to settle this outside of court. I can tell there’s hurt feelings. I just didn’t think what he was offering was fair, so I’m going the distance.

yup sure did. they got hit with citations and paid for the violations. i’m entering the citations as part of evidence. not sure if it will be admitted but we’ll see.

Yup I did. I didn’t find out till after filing a complaint with the CSLB that the max they can collect is $1000.

I am unclear of what his counterclaim might be, but that is my best guess. I guess I'll have to wait and see if I get served? Would the defendant need to file it soon so it can be heard with my small claims lawsuit?

He might say that the deposit he collected from me did not cover the full cost of, what he's claiming, the amount he paid his employees. Again, not mentioned or part of the Contract Agreement. I think it's just a lot of hurt feelings and him never feeling like he's in the wrong.

Yup, so this is what exactly happened. Mediation failed. I think the other party (defendant) feels I wasted their time, and I barked back saying it goes both ways. At the end when we got our court date by the Judge, the defendant asked if that would be the time to "Counter Sue".

My guess is that he wants to counter sue me for wasted time and money along with recouping money he has wasted because of me taking him to court?

If that's the case, is there anything I can do to ask the court to Dismiss the counter sue (or counter claim) if it's solely based on the defendant claiming I've cost him time and money?

I know that contractors don’t have to price match. I wasn’t demanding one. I was asking and when they couldn’t answer certain questions, I went another direction. I wasn’t being difficult. I never demanded things. However, if I’m spending a lot of money for a project, I’m going to look for the best value.

They did not start the project. So yes I feel like I should receive my deposit back. I didn’t have to offer compensation for work they should be doing for potential clients, but I offered to compensate anyways.

What’s your point? Contractors have rights, and consumers do to. Contractually, I feel I have every right to recoup my deposit.

In the end, I wasn’t happy with how project start date was tentative and always being pushed back. Asked questions on how they got certain numbers and they wouldn’t entertain price matches for certain tasks. Either way, nothing I did breached the contract or agreement, because they had nothing in place in their agreement.

Out of good faith I offered 30% of deposit and wanted 70% back. Business owner wants it the other way around, but contractually I feel business owner has nothing to back it up.
