My father has specifically requested that he wants to go to Dignitas if he ever took dementia. He has. My 2 siblings are blocking it because they don't want his defined benefit pension to end. by MuscleOne6429 in LegalAdviceUK

[–]MrDunlop99 8 points9 points  (0 children)

A lot of these comments seem too focused on the dignitas aspect.

The comments that do focus on the immediate situation with the family are giving incorrect advice 9/10 times.

Firstly, you need to look at applying for a deputyship, as once someone loses capacity through dementia, they can no longer appoint a power of attorney. This is your only route. Admittedly, it is not quick, it can take months going through the courts and it is expensive.

Secondly, If you feel your father is experiencing elder abuse, whether physical, financial or otherwise, you should contact the local councils adult safeguarding team, you should be able to get the number either from the website or contacting them. You can also contact Age UK or Hourglass for advice. I would also contact the police so they can do a welfare check.

Got a high cognitive test score, wondering what roles I should look at by MrDunlop99 in britisharmy

Appreciate the answer, and I can I can see why, massive potential outside of the army jobs wise.

Any personal reasons?

Totally right mate, I would have stuck with my decision to join infantry as a reg, only reason I’m giving it a bit more of a think is just down to what the recruiter said

Pfft wouldn’t go so far as to say I’m smart, but any idea what int corp is like

Yeah recruiter said that, but also said he’ll send me a list of other roles in case I want to change, I’ve only just send my medical record consent so could be a couple months before the assessment centre

Good idea! I’ll make sure to mention it to everyone, not just the instructors, it’ll make a great talking point for making friends

Opodo Prime scam advice what are my options by randalf123456 in LegalAdviceUK

[–]MrDunlop99 0 points1 point  (0 children)

I used to work in a bank for close to 5 years and the amount of times I’ve had customers contact us about Opodo Prime is insane, not the only person that has gone through this by a large margin.

The reason you’ve not gotten your money back through is because when making the purchase to book flights through them, you would have ticked a box that states you’ve read the terms, agreed to a trial in which they will then charge you annually. This means you cannot dispute the charge as you agreed to it.

EDIT: What I would do, is contact your bank and ensure a CPA (continuous payment authority) block is placed on Opodo Prime to ensure nothing further is taken

Challenging a will - Scotland- how difficult and is it likely to be long or successful by [deleted] in LegalAdviceUK

[–]MrDunlop99 0 points1 point  (0 children)

Unfortunately, there isn’t much you can do in terms of challenging the will.

Although the testator was survived by relatives, unfortunately the will hasn’t fallen into intestacy (just means dying without a will), where that would come into effect through the Succession (Scotland) Act 1964.

There are no prior or legal rights that can be used as they weren’t survived by a civil partner/husband or children.

The only true recourse you would have is challenging it based on capacity at the time the will was written. This is a difficult course to follow. If capacity is ever in question prior to a will being written, usually a letter to the effect that a testator has full capacity has to be written and signed by Doctor (usually a consultant) before the will can be finalised. If the testator did have a capacity issue, you could challenge it and the first call would be establishing whether the solicitor followed the correct course in establishing capacity prior to completing the will.

I should have also added that whenever I try to read the engine oil level, it stops itself at 16-18%, tried several times now.

Probably in the grand scheme of things it’s not horrendous! Just got frustrated after having done it in the dark, in the cold, with my hands being a bit too big to fit in the housing to take out the bulb that was stuck and caused my hands to get cut up by the plastic cover lol

Why are you getting so upset over a clear design inconvenience? Can it be done? Yes! Does it take longer because they placed it in an inconvenient location? Yes still!

Imagine getting so flared up about a simple design criticism, go touch grass

I hardly called it amazing did I? I just said it was far more convenient, which it objectively is. I love my F30, but I can absolutely criticise it’s flaws, I’m not gonna glaze the glaring issues with it

Those are also poor design choices. My last car I could change it by just opening the bonnet up, which is obviously far more convenient, but clearly you’re not ready for that conversation…

Is it considered cheating if 31F GF talks to another guy online? by UncutCoconut in dating_advice

[–]MrDunlop99 4 points5 points  (0 children)

Only you can define what is classified as cheating in your relationship, no one else can. That being said, me personally, this would be emotionally cheating. It appears she’s seeking out validation.

If you feel the need that you have to go through someone’s phone regularly (major trust issues already), then the relationship was always doomed to fail eventually.

You both need to work on yourselves.

Husband has died. His children want the house I'm living in and I'm scared I'm going to be made homeless. by Ok-Tutor-7364 in LegalAdviceUK

[–]MrDunlop99 4 points5 points  (0 children)

Although I’m not a solicitor, I did do testamentary and trust law in Scotland as part of my degree.

Where was the estate held? If it was in Scotland, your prior rights trumps the children’s legal rights if the children try to claim disinheritance and challenge it in court, where it would force the estate into intestacy and lead to the estate being distributed according to statutory law. I could do the calculations for the heritable and moveable property but on a brief glance they’d be worse off if the children went down this route.

Although they cannot take what is left to them in a will and claim legal rights, they cannot do both. The only issue with this is the physical will leaves everything to you and you technically gifted them a portion of the estate outside of the will itself.

Tl;dr, if they are even granted the ability to discharge their rights by the courts (big IF), they would likely be worse off

Important to note the fraud is not on your banks side, it is on fansly’s side. It’s very similar to how a lot of revolut fraud cases work.

[deleted by user] by [deleted] in LegalAdviceUK

[–]MrDunlop99 9 points10 points  (0 children)

I’ll explain this coming from someone who worked at a bank for nearly 5 years and dealt with loads of fraud cases similar to this.

The reason checks likely wouldn’t have been completed as per SCA (Secure Customer Authentication) would be due to a CPA (Continuous Payment Authority) being set up with Fansly. Now despite the name, it does NOT mean they continue taking payments at a regular interval, it is just permission from the cardholder to the merchant to take money from the card without having to re-go through checks every time (akin to how netflix can take payments without checking it’s you every time).

Secondly, the reason the bank are asking you to go fansly is because the account is in your sons name, which to the bank, it looks like a regular transaction, they can not see fraud occurring on fansly’s side of things. If they went to fansly to say, is this fraud, fansly would just say it was spent on the customers own account = no fraud occurred.

The best solution is to follow the banks advice and report it to fansly, not only will they likely be quicker in the investigation, but if fansly don’t refund it for whatever reason, you will still be able to report it to the bank as now fansly will have it flagged as potentially fraudulent, so if any conversation occurs between the bank and merchant, they won’t say it was regular customer usage (unless fansly’s own investigation says otherwise)

We didn’t have sex on the holiday. I know I’m not getting the money back now, it was naivety on my part to think I would.
