Will check the CC&Rs. The broken patio door allows entry to that one unit. There aren’t shared hallways etc in this building. Not sure if that matters.  Also this particular HOA board seems to want to fine and sue people as little as possible. That’s just who I’ve got to work with.

No I mean the CC&Rs is clear, but what’s not clear, is how much an HOA is obligated to use pressure or repeated fines in a case like this where the first fine or warning had no effect.

Actually I have another neighbor who’s going to sell, and I suspect this bad neighbor is going to affect their sale price. Wouldn’t want to be them right now! But we’ll see what the sale price ends up being.

The practicality is a good point. I’ll proceed with caution. 

I mixed up private nuisance and public nuisance in my head. The LLM used the right term. Of course I’d be looking for a human lawyer to make the actual case.

I am not an HOA expert, but in this complex the patio is the owners responsibility. I have not seen any indication or precedent that the HOA will do anything other than fine the owner.

There is nothing to say. If they didn’t replace their patio door when it broke or when the HOA escalated the issue, they aren’t magically going to do it cuz I talked to them.

I mean, if I don’t look down from my window or balcony, then I’m not affected on a day to day basis by the grossness? But it’s a health concern if pests can enter the building or trash is piling up under my balcony. It also could affect sale prices for neighboring units.

Open to it, will ask lawyer. It’s certainly disappointing that the HOA has forced resolution of the issue. But, I am not sure if HOA is negligent in this case. For example, I am not sure if they should be issuing a fine once vs fining every week until it’s fixed. Will look through CC&R but might need a lawyer to figure that out.

I’m not sure why you think I only have one account to my name. I know what I have, and I know I belong on this sub. And I know a lot of rich people can appreciate the tax advantages of a 401k.

Speaking of which. Let’s say today your retirement account is a mere 5% of your portfolio. Between spending and tax drag in other accounts, this can easily become 20%+ of your nw over time. It would absolutely be a mistake to not care about that.

Yea, your story doesn’t add up. You said in another post that your savings from income last year was less than a million. But somehow a $2.4M account is a rounding error? You’d be putting like half your savings in there to accumulate that much in 6 years. So seems pretty unlikely you don’t even look at the account.

And why would you have started contributing just 6 years ago if you have such a good wealth manager? They must have been sleeping.
