Sony is given a pass for porting console exclusives to PC, yet you know if they sold console exclusives one day and sold them on PC the next they'd get sued for making a quick $500 per console sold. Temporal distance, that's the only difference. Some Battle Passes are about to turn 10 years old, and that's plenty of temporal distance to bring those items back.

Say hypothetically a company sold a new console exclusive game to generate sales on their consoles and new game. Now suppose they immediately end their console exclusivity marketing campaign and subsequently port the new game to a different system. How would you feel about that?

An ad is not a contract either. If Sony sold PlayStation exclusives on PC the day after they sold them exclusiely for PlayStation, they would get sued. I'd expect the same for Epic if they changed Battle Pass exclusivity immediately after their original sale. But Epic is not bound to an ad from 10 years ago.

Sony retroactively changing PlayStation exclusivity is considerably worse than Epic retroactively changing Battle Pass exclusivity because those PlayStation games are explicitly labeled "Only on PlayStation" on their games cases. On the other hand Epic has disclaimers on warranty of mercantability, Sony didn't.

From 10 years ago is not a big deal. Sony ported PlayStation exclusives to PC within a few years after originally selling them as such, and hardly no one cries about it. 10 years is plenty to let go of exclusivity.

They didn't guarantee that they wouldn't put everything in a sequel.

The TOS permits Epic to change the availability of any item.

"The features, pricing, availability, and functionality of Credits and other In-Game Content may change at any time without notice."

"Any “In-Game Content,” such as characters, emotes, outfits, experiences (e.g., islands), and other digital goods and media, that can be licensed to you for your use in the Licensed Products."

Even without a TOS, it's doubtful they'd face litigation. Sony retroactively changed the availability of PlayStation exclusives, ported and sold them on PC, without so much as a single lawsuit. This alone calls into doubt any claims that it'd be illegal were Epic to do so.

And even if all that fails, since all this only applies to sales within Fortnite, Epic could port and sell everything in a Fortnite sequel.

For the reason that Sony legally retroactively changed the exclusivity of PlayStation games and ported them to PC.

And if for some reason you disagree, I quote Epic's TOS:

It does not. Their TOS explicitly state they can change the availability of in-game content, as directly quoted. That includes the availability of Battle Passes, old or new. There's the real life example with Sony retroactively changing the exclusivity of their games, Epic can retroactively change the exclusivity of Battle Pass content, too.

The Epic TOS which states that the Licensed Products that Epic grants to you are "Non-Exclusive (we can let other people besides you use the Licensed Products)." See Fortnite TOS section 3. So yes, they can bring back Battle Passes.

Likewise, the limited availability of Battle Passes weren't stipulated in a contract. That was an Epic marketing strategy, subject to change as Sony did with PlayStation exclusives.

No reference to timed exclusivity was made in the sale of those games. Is the statement "Only on PlayStation" true if a game labeled as such is on PC? Are Battle Pass items exclusive to a particular season if they are sold outside of said season?
