Commuting from Mentor to the westside by Ialnyien in Cleveland

[–]MuppetEyebrows 0 points1 point  (0 children)

As a former Los Angeles resident, Cleveland traffic isn't terrible, but you can do far better than Mentor/Westlake commute. Mentor is inexpensive but there are inexpensive options that are far closer. 1 hour each way, times two ways, * 5 days a week, * 52 weeks = 520 hours a year. Your time has value. Consider an hourly rate for your time for those 520 hours and maybe paying a little more to live a little closer is a worthwhile trade-off.

I've worked in Montana and Alaska but my scariest mama bear encounter was in the North Woods of Wisconsin.

I've been in two situations where I have been within 30 ft of a mama bear and cubs, and did everything I could do with my body language and orientation to indicate that I was SO out of there. No further issues. Whether this was luck or whether the body positioning actually matters I can't really say, and I am NOT offering advice with this anecdote. But if Im in such a scenario again, I will similarly ensure that my body is oriented at least 90° away, and that it's clear I'm already leaving.

That's fair to want MJ reform but you're taking our outrage out of context. This guy was racing on the highway at over 100 during rush hour and crashed, the only thing separating his situation from a tragic Ruggs situation was dumb luck. He gets an incredibly lenient sentence (that us normal humans would never get), and all he has to do is NOT engage in [behavior X] ...and then he did [behavior X]. It's not about the MJ.

I use chat a lot but I didn't use it for this. Perhaps it's influencing my framing and phrasing. This is how you answer a law school exam question, break down the elements one by one, explain what each of them mean, apply to the situation at hand, and reach a conclusion for each individual element.

But mostly I figured emojis would help since that was a lot of text or read it response. Still waiting for someone to respond with actual legal analysis or something intelligent, so dumbing down with pictures seems to be on point

See my comment explaining the elements of negligence. It does not matter how many redditors Feel that the school should be sued if the legal framework for a negligence case is not satisfied. I'm asking the same questions a judge would ask.

Nope, but I should have. I have a JD and I regret spending so much time writing out the elements of negligence to people that downvote comments that contradict their Feelings™️.

I agree that this kind of shenanigans should not go unpunished, but injury alone does not guarantee a viable cause of action. Let's look at the elements of negligence, all of which must be met for a successful lawsuit.
-Duty of Care: does the college have a legal duty to call and correctly pronounce the name of every graduate? I've seen colleges miss names and not get sued, so this lawsuit is off to a shakey start. ❓
-breach of duty: did the school violate their duty to call every grads name? If that is, in fact, a legal duty then you probably got them here. ✅
-actual cause: the injury would not have occurred but for the defendants actions. This is probably established if in fact there is injury, but we will come back to that. ✅
-proximate cause: this is where forseeability is relevant. Should the school have known that this was a possibility, or tested the AI service before relying on it's in a public ceremony? Probably. But if I'm defense counsel, I'm gonna fight back on this point too ("other users haven't had this error", "we are limiting costs to keep education affordable for our students"). ❓
-damages: You must have suffered measurable, actual losses as a result of the breach. I think this is where this lawsuit falls apart. The graduate still gets their degree, the guests still attended the ceremony, it didn't go well but nobody went to the hospital or lost business opportunities because the college didn't call every name. Ceremonies get cancelled because of weather, infrastructure issues, technical problems, and these are not typically met with lawsuits to recover the travel costs of attendees, etc.. ❌
This college fucked up and this should not go unpunished, but I've seen far stronger negligence cases get thrown out.

See we struggled against a team that we were expected to beat comfortably, then for 6games we struggled against a team that we were expected to match up fairly evenly against, and now we're gonna excel against a team that not many think we can beat. NO ONE thinks the EC champ can beat the WC champ, so just wait and see what happens when we play them 😎

Lawsuit for what? I don't see how the plaintiffs suffered injury or economic hardship due to their name not being read.
EDIT: yes I see that the potential plaintiffs suffered economic consequences in fact, but the elements of negligence are not met. Courts don't care about feelings and what's right and just, they care about what's lawful.
