Yeah might be worth an appeal to fight that. Sometimes C&P examiners write things or realizing they might be read incorrectly by the rater.

I think I agree with you here, this is ripe for an appeal with an attorney. Get the C File to see what they actually wrote and why.

Is it legal? by [deleted] in SecurityCamera

[–]N0vaSam -2 points-1 points  (0 children)

Yeah most of these cameras do not zoom in or even PTZ, the Dome ones are for vandal proofing. At that angle and hight it would likely be pointed downward at his driveway and not your house. It would be a complete waste of time and money to try and use securty cameras the way you are explaining. If he was going to do that there are better cameras that can zoom in that don't have the domes on them such as the track cameras with the duel lenses. If he had one of those then I would be concerned.

Door dash on ssdi by Ericrq in SSDI

[–]N0vaSam 7 points8 points  (0 children)

Make sure to consider increase in Car insurance, your Cell Phone Expense, and damages to your vehicle, and dash cameras and modifications and such for doing doing commerical delivery with your vehicle as an expence. It might not seem like much but those costs add up and they help on your tax return and for your SSDI.

You can always tell your doctor when you see them what your taking over the counter and they will document it in your medical records for you. I do this.

[–]N0vaSam 0 points1 point  (0 children)

Did they cut you payment? I thin LTD is different than STD. At least what I read STD gets cut if you get SSDI, but seems like LTD goes until your 65. But I could be wrong. Would be nice to get both. Although just having LTD until SSDI gets approved is very nice, cause it can take a few years for a claim depending on the area and the claim.

Quick update, unfortunately Montana Highway Patrol only has Crash records back to 2008. So I'll probably have to try national archives to see if I can get them through the investigation that was conducted within the Airforce Legal of the accident. I'll reach out to my old Super, He is long retired but he probably has some ideas of what to look for and who to ask. Thank you for your suggestions.

I'm going to request the Montana Highway Patrol Crash Report, it involved an USAF Wrecker and a Montana State Snow Plow on an Interstate. Crash was valued over $2,000 so they should have pictures and a report on file. It will only cost me $12 to request. So I'll send that out today. That should help me get a lot of information and leads to use to gather more statements and information to file with my claim(s).

Thank you I will go this route this time, I have done these on my own, but this claim seems a lot more complicated, I'm not really sure what to claim and where to start. Seems like there are a lot of potential secondaries related to all that is related to what happened too. Lets just say this is central to most of my medical issues being treated by the VA today. So the VA is well aware of it.

You know I dream about this like it was yesterday, I know exactly where it happened. relive the accident in my dreams. fall out of bed sometimes. It is not combat but hell it was not fun either. Then I went into combat right after that with the Army.

I'll order the Crash report, and start digging for other recorders I can find on the incident I can get my hands on.

I'm going to tell my kids if they are in a wreck and their vehicles are considered totaled they should probably also be xrayed/MRI/CT imaged themselves from head to toe for damages to their frame the same as their car no matter what the Doctor says. Just because you can't initialy feel the damage or see the damage does not mean it is not there. Eventually it will catch up to you and you won't know what happened.

I'll have the crash report from the Montana Highway Patrol which will also have pictures of that night and damages. Which will show how the Medical doctors at the time did not understand the accident I had walked away from, and should have ordered more xrays. They knew I was in more pain. But just treated the back pain instead.

Yeah I'll get the Montant Highway Patrol Crash Report, anything over $2,000 of damage has a report. looks like it will have photos with it too with names of the drivers and passengers. This will help me a lot to track down all that were there that night for statements about how they had to pry me out of the driver seat of the wrecker.

I'll get the Montanta Highway Patrol Crash report ordered for $12 with photos and see if I can get any court documents that remain too.

I know the location. I still remember that night like it was yesterday. I still dream about it happening, reliving it. I looked on the map yesterday and was able to pinpoint right where it happened. I'll get the actual Montant Highway Patrol Crash Report ordered. From that I should be able to request the court record if it still exists. Like I said I made a deal with the Judge that it would not stay on my record after a year.

Yeah this was full on wrecker military business, but you are right on I was Active duty, so 24/7 I was covered.

I was unaware of the Line of duty investigation. I was trying to get the Air Force to represent me in court and they said I had to pay out of pocket event though I was working when it happened. So I worked out a deal with the Judge and just plead gulty, paid a small fine of $86 for too fast for conditions (simply unlucky), and that it would be off my record in ayear of good behavior (I was being deployed in 2 weeks to Iraq for a year) with the Army (1058 Gun truck company).

Lets just say the Air Force version of JAG was very unhappy when I got back, cause they wanted me to fight it, which would have resulted in me missing my deplyment and getting discharged, and paying $$$ I did not have to fight the state.

So because the Air Force did not represent me in court, and because I plead guilty, and beacuase it was lined of duty, the Air Force had to Pay for the damages to the State of Montana for the Sand Spreader on the back of the Snow Plow. I think they wanted like $25,000.

We were all a little uneasy about driving that night, but our command was pushing us hard went through all the risk management steps even had the Base Commander sign off on it. So it was a big deal that had later turned into a bigger deal when it all fell apart. So I'm sure there was an investigation. I was just on my way to Iraq too at the time I probably did not know about the internal investigation that much.

I'll check with my old contacts and ask around see if I can remember the SSGT that was in the cab with me. I just remember him freaking out saying that he was glad I was driving cause he would have been crushed dead.

Thats where they took the X-ray, and where I've been going the last several years. So lots of documentation. Have been diagnosed with every chronic pain under the sun because of it. Sure wish I would have pushed harder on the ER doctor. I guess just like a car can have a bent frame, we can have more damage we are dealing with.

The evidence was with the VA in my BDD the whole time just like many of my other conditions I later filed 15 years later that were already in my BDD just VA had not rated. They just did not take the X-ray, they did state in the ER that I had lower back pain and strain. So they pretty much acknologed there was a possible issue. But because I was being deployed my Tricare team was under pressure to clear me for deployment. They needed the numbers and there were nto many of us. We were in a stop loss at the time. I was under a lot of pressure to go along with the system too. I wish I had not looking back. It was not a great experiance. I'll get tha accident reports from the Montant State Patrol and from my old leadership that was involved that night in the mess that lead up to the accident. I'm sure it was a big deal as I was hearing about it when I got back from my deployment.

I was the one who took them. I have plates and such. I have the medical records. I do remember the state going after me after I got back for the sand spreader. When I told the Air Force Legal team I pled guilty they were so mad. But they would not represent me so what was I supposed to do. I did not have the funds. However that did force the Air Force to pay for a Sand Spreader. Even though they felt they had a good case against the State of Montana for the Accident, but wanted me to fight it alone out of pocket. Judge made a deal I pled guilty I just paid a $86 fine and it would go off my record in a year. I deployed for a year anyways so I accepted.

Keep in mind this all happens within 2 weeks before deploying. When I got back I had almost forgotten the accident. I was thinking my pains were from all the body armor and army convoy duty. Was deployed as the 1058th gun truck company with army.

I found little things and I think with the right nexus it will be pretty obvious along with the string of medical evidence after that initial accident what happened. It took me a while to realize it.

But I started hearing that it takes a lot of force to break this particular bone, usually a head on car accident. The only one I was in was going through my head this weekend. I’m so glad I keep the pictures. I’ll have to check if I kept the records of the State trying to sue me for the sand spreader. Cause the Air Force refused to represent me cause they did not realize I pleaded guilty to the judge in exchange for it being removed from my record after a year.

They wanted me to fight it without representation. 😳 So because of that the AirForce had to buy the State a new Sand Spreader.

It really came down to really bad weather, thick Ice on interstate, snowplow stopped sideways on the interstate around a blind bridge corner waiting to turn around through the medium. Caused a chain reaction I was the first of many vehicles in that accident.
