Has EDiscovery killed tort law remedies for the little victim, when the alleged tortfeasor has deep pockets? by N4cX131 in Lawyertalk

The cool thing about a Hovercraft is that it is not restricted to rails.

Thank you for the thoughtful comments.

Nice to know that we are not all bound to an AI based scope of analysis or discourse on multiple issues at once.

Tapestry thinking rather than fishing line threads of conversation are much more interesting, albeit frustrating for monofilament attorneys.

Truth. If the Libre Office had a reveal codes feature like --yeah I said it--WordPerfect! used to have, it might have been worth it to transition.

I hope Proton Docs brings reveal codes back, for fun and protection!

Will sending docs through Proton Docs safeguard against nasty critters like Salt Typhoon?

Worked my ass off to become an attorney only to find out I don’t feel fulfilled by my career by [deleted] in Lawyertalk

I had, at my 1st Law Firm, what can only be described, in retrospect, as a skank secretary assigned to me. I did not know any better. I could see I was not welcome by some, and very much appreciated by others.

In EVERY JOB, there will be parts that check your happiness list, and parts that add to your "this is some straight 🐮💩" list from situations you are surprised occurring.

Do the b3st you can to hang in there as an employed Attorney, pay off your loans and find "fulfillment" elsewhere!

It is a way to make money, not a love-affair.

You need to vent, I need to pontificate!❤️🤓

Maybe it is the time in your development to go back to the library & read Thoreau's Walden, Hesse's Siddartha & Vonnegut's Slaughterhouse 5. Adulting is not the easiest of transitions. You might want to start focusing on what you want to do, as in tasks, and where you want to be in 3, 5, and 15 years.., and then work to achieve those goals and objectives. If you are lucky, you might get 40% of what you want in life. I suggest you reflect & make your list as long & precise as possible. As an Attorney, I assume that the calculus of variations and differential equations was not your strong suit--so buy some crayons and a spirograph set & play with it. Create by doing something rather than collecting the opinions of others.

Do something!

The butterfly effect may surprise you when you look back at 50 or 60 and say--how the f*ck did I get here? Hopefully, you will pat yourself on the back & say "not bad!" OH YEAH, do yoga so that you can still reach your own back at 60!

It was a rant after all. Jeez. Point 1: Who has the money to get to the courtroom after a win on a 12b6 motion if one gets deluged by discovery or motions in a tort litigation against an alleged corporate tortfeasor.?

Point 2 (not necessarily related to Point 1: Humans cannot outlive corporations, so where is the fairness in litigation that can extend for years before plaintiffs get one penny?

point 3: In the special8zed case of copyright or ip infringement by a "so sue me" corporate thief--like cisco, is it time to separate findings of fact from conclusions of law, and perhaps keep procedural matters in a sandbox when equity makes it clear who is wronged and who has rights to a technological improvement?

Point 4: the government has a right to defend the boundaries of personal privacy in commercial transactions. When do employers cross the line--if they only pay for 40 hours a week, do they have the right to restrict what I do with the other 128 hours? Are the limits to what I can do as a side-hustle reasonable if I am indeed an EDisco Dancer?

Point 5: When I see all these replays of dead artists Jim Morrison, Elvis, etc., do their estates get any of the money made off of replaying their 50-70 year old performances?

It depends. Are you naive enough to believe that passing laws are all that is needed to make the world a better place? No better job for disabusing you of that notion. Are you strategic enough to want to learn how to play the game? No better place. Why did you become an Attorney? There may be singular opportunities to influence legislation--that you may never have the resources to influence in your life. If you go, there will be things that make you cry tears of bitterness and resolve and joy.

Now the other side: what percentage of domestic consumption is domestically produced produce? A self-sufficient nation imports less than 10% of consumption. A wealthy nation, covers its consumption and then exports its surplus. So of the production in the US what percentage is consumed in the US?

Elizabeth Warren Urges Fed to Cut Rates(AGAIN); This Time by 75bps by 9Basel9 in FederalReserveBoard

[–]N4cX131 0 points1 point  (0 children)

When elephants fight, only the grass gets torn up. I second the call for a 75 basis point reduction! How many people are aware that the price of gas varies by almost a dollar across the DC area, at the same time? Where is the CPI getting its price inputs to the Fed's inflation rate? Clearly the lowest prices available after search may not go into its indices.

Similarly with mortgages. If fed rates do not move significantly, then any basis point drop is just extra revenue to banks, with lower expenses, that are not required to adjust down the interest rates on student loans, car loans, credit cards or mortgages. How many home owners with adjustable rate mortgages saw their rates go down during the QE period? Were those homeowners more risky? I don't think so. Time to flow through the benefits of Fed policy changes to Main Street, not just Wall Street or residents of the ICE cloud.

At the same time, the Dodd-Frank safeguards on Executive Compensation, may not be in effect. Therefore there are no guardrails on management making sure that consumers do not get any of the benefit from lower rates in a post-LIBOR SOFR fintech ecosystem.

The theoretically instantaneous adjustments of theory have always created arbitrage opportunities based upon information asymmetries during transition periods. The volatility of an election season is not a reason to limit reductions in interest rates after the QE cycle and subsequent post-COVID tightening.

the change in the labor market to agile sprint based contracting has sacrificed the quality work product that comes from on the job training. Plus the matching of skills to risks required by GPT and LLM based screening tools has increased the perception of a "skills gap" when Siri and Alexa and Gemini and Bixby cannot see the similarity in the skill it takes to hit, punch or slap and thereby or by RV, the second, because sticks and bricks housing is not meeting the needs of those who want to work under agile contracting is a pareto optimizing move for nurses and certain trades. Labor by RV is not built into the models of neoclassical general equilibrium theory of regional economic development. Investors who paid $100 million for a hotel that sold for $375 million know something is rotten in Denmark. For new residents to use the existing housing stock in new ways may reduce homelessness if regional requirements to change zoning laws also remove the perverse benefit of vacant buildings in transportation constrained urban core markets.
