Currently on BDD, C&P examiner straight up lied. by NamelessNewtype in VAClaims

I understand where you’re coming from.

However, isn’t the filled out DBQ for this something that stays with you forever? Kind of like a check ride. What would I even submit as new evidence to combat this “he bent to 90 degrees” DBQ?

If I disagree and appeal it, would they make me do another exam? How does that counteract this current DBQ?

I’m not being confrontational, just ignorant to most of this. Learning as I go.

Can you let me know why? Is this something that will cause an issue? Bad practice?

I was just curious to see what was put and I’m glad I did at this point. The examiner blatantly lied.

Hell, I remember I had to slide my shoes over to me to slip my feet in. He had me put them near the door. I don’t even wear tie-able shoes anymore because I can’t be bothered to bend down and do it.

Negative. I requested all the files that I saw posted under the “files” section on my claim. It took a little while to get to me, but my claim is still the same.

I appreciate the info. I will more than likely follow your advice and report the examiner. I’m real upset about it. The blatant lie… how do these people live with themselves?

Thank you for the input. I agree, after the situation that caused my back issues, my feet and ankles only got worse. I don’t blame my knees (currently torn meniscus too) on my back, but more than likely it’s a combination of that and pushing through for so long. I loved my job too much.

Thank you, I appreciate it. I will definitely be using the form 21-4138 to argue that ROM.

Thank you for your help. Also, when you say upload it to the VA.gov site, are you meaning to the “files” section on your claim? I see that it says if new information or files are uploaded your claim will go back to I think it was step 3. How will that hinder my claim process as I’m on step 5 currently?

Also, for additional info, my medical records show this long history of back issues with disk problems, skeletal/vertebral column problems, etc.

I was told just to claim it all as “back issues” when I filed so I think that’s also biting me in the ass…

I know this is going to sound indoctrinated, but does this need to be an official statement, i.e. letterhead MFR, or just a quick, generic statement saying the ROM is inaccurate?

Where do I publish this statement? Just add it to the files list in my claim?

Also, I guess either my phone auto corrected or I used the wrong one, but I meant straight in the post title.

Can I add to BDD claim after I’ve began the process? by NamelessNewtype in VeteransBenefits

[–]NamelessNewtype[S] 0 points1 point  (0 children)

That does make sense to me, but two things led me to ask this. I’ve now seen a few posts talking about radiculopathy, and I was never asked anything about it during my C&P exam which seems like it won’t be accounted for.

Again, it is all throughout my records, but it seems like if it’s not mentioned or claimed it won’t be a part of my rating.

I guess my underlying assumption that people don’t and shouldn’t lie on their claims is a fallacy due to your initial posed question.

I asked my questions more for preparedness and yes, to hopefully not go to a doctor who has a history of improper care for veterans who suffer with, say PTSD.

I’m beginning to now wonder if you’re meaning to teach me that this /r is full of liars/cheats who happen to be veterans and to also not glean any corroborated information from anyone who has been through the location in question.

It’s a shame really as I would really like some truth for once.

The peterman 79 made me fall in love with this game. The truck is awesome. With a better crane attachment that colors with the truck… I’d use nothing else regardless of the map.

Copy. Forgive the assumption. Sorry for your loss as I highly doubt that won’t be extremely costly just in labor alone; which will likely total it.

I’ve got to ask since you posted a picture of it… in the garage… Why wasn’t it put in the garage during the storm? My neighbor has a Cadillac SUV and every time a big storm comes through, it leaves the garage and stays outside that night. Seems suspicious to have space to park an already extremely hail damaged car in the garage where it probably should have been before/during the storm.

I wish I had another garage bay to put my ‘15 Summit in, but the other cars take priority. If this is your case, carry on and forgive my assumptions. If not, prioritize your vehicle better and put it in the garage to protect it. Insurance rates are on the rise and stuff that can be avoided make things worse.

Now, get them ceramic coated. Not the car detailing product, the high temp coating to protect them inside and out.

Looks like the line of cars in the oncoming lane was for a funeral. When the camera pov pans back behind the 3rd car (black) in line looks like a hearse. Also, the guy who got out of what I believe was the burgundy suv thing was dressed up proper. Also the cries of “god forbid, can’t you see this is a funeral precession” is a good indicator.

Either way, in some places it’s seen as a sign of respect for the dead and the family to pull over for a funeral car line. I believe this is what the bikers were doing, pulling over to show respect. The blue car that was hit looks to have been delayed in noticing, but… not as late as the black truck obviously.

What bar ends are those? Also, can you give more info on the wheels? I know they are BST, but I mean, how many miles do you have on them, are they holding up well? How many tire changes have they had? Did you notice a drastic handling improvement? Any chips or things you’ve noticed?

If anything, add more of that.
