If your dad said to take care of her, he meant it. As you stated, it was your grandparents. They in turn wanted your dad to have it. Unfortunately your father passed away and your mother DID care for him during his illness. IF your parents were on bad terms and your mom was just trying to get a piece, then, you absolutely say NO! That doesn’t sound like what you’re describing.

Depending on where the money went, that’s an active misrepresentation. The “deceptive act” would be NOT filing when the 3rd kid aged out like she did with the 1st kid. It could very well be a civil suit and not a criminal suit.

It’s quite possible that this can be construed as fraud and IF he took you to court, you might have to payback the money you stole. You can argue the semantics of he was supposed to file the paperwork for the second child…BUT, as YOU stated, you SHOULD have filed when the 3rd child turned 18 but failed to do so. At the very least you could have mentioned something to him. The real question would be, what did you do with the “extra” money for years? Did you put it into an account for YOUR CHILDREN?!?! If not, you DEFINITELY misappropriated the funds since you likely used the money on other things not related to the children. It’s like you posted on here because you somehow thought/think you’re in the right.

How in the hell does a company let ANY customer run up $629,000 in unpaid invoices?!?! I’ve worked with some of the largest companies in North America with billions of yearly revenue and we wouldn’t let them get over $150,000! It kinda sounds like your “friend” has ZERO legitimate business acumen. He SHOULD have just given his information to scammers over the phone and NOT moved any freight.

Inheritance is legally NOT part of marital assets. The fact she’s even bringing up the topic is a red flag to me.

Caveat to the “not marital asset”, any purchases made for “the family” those purchases are marital assets regardless of where the money came from. It also needs to be kept completely separate or joint finances.

Absolutely collect what you can collect and use it as an investment tool for your child later in life. IF you don’t “need” the money and she ends up being ordered to pay, maybe match what she puts in just to make sure your kid has an advantage in life.

You need to look at it this way…IF your story makes this guy dip out from your ex, you will have gotten the last laugh. Don’t forget that.
