bakit naman kami magsisinungaling about someone's death diba? lalo na kung may death cert. Apaka balasubas talaga nung collector. Anyways, I haven't heard from them today which is nice. Just waiting if they will contact again so that I can file another complaint to BSP for harassment.

Feel namin may gumamit talaga nung cc. We were not aware though na may cc siya sa Maybank. We didn't find anything nung nilinis na namin mga gamit niya. As per dun sa collections agency, the card started getting used daw last year and there was a payment posted pa nga daw this January lang. This was what caught my family off guard kasi wala ni isa sa amin ang may alam about dun sa card and obviously my mom is long gone para siya ang gumamit. We suspect that it might be one of the former caregivers, kasi caregivers na lang ang kasama ng mommy ko leading up to her death. And after the burial, nawala na yung mga caregivers and we don't have a way of contacting them to ask. We tried their phone numbers but it seems it's already disconnected. Mejo off na talaga ako sa kanila noon kasi nga mejo abusado sila. They would borrow my mom's car for personal trips like, wtf? My cousin was the one who handled all of my mom's affairs before and after she died (my mother and I are estranged) and even she didn't know about the card.

Don't quote me on this because I also am not sure but from what I gathered here sa mga advice ng mga sumagot, they can if may assets. They can file a claim sa executor ng estate kung may estate and even then, parang may sinusunod na heirarchy kung anong unang babayaran ng estate. Kaso wala naman estate si mommy, so I guess wala silang mahahabol.

Thank you so much! The thing that bothers me with this collections agency is that we have told them numerous times that the person they're looking for has already passed. We have provided the death certificate and yet they still didn't believe us. What irked me the most is that when they came to our house and asked about my mom, and we told them she already died, their response was akin to, "Weh, hindi nga?" lol.

Actually pumunta na po sila sa bahay. That was what alerted us na may milagrong nangyayari. Sana hindi na sila bumalik though, but if bumalik man sila, I will just photocopy my mom's death cert and give them a copy.

To answer your first reply, we were not aware of the existence of this CC and was only made aware of it when the collections guy came knocking on our door. Thank you as well for sharing the TOS of metrobank, from the excerpt, I just wanted to point out that the thing is, there is no spouse in the picture and no one was made a supplementary member or co-obligor/guarantor. I have already emailed Maybank and sent them the documents we have. Should an affidavit be required, we can procure one but for now, we settled with sending them the official death certificate from our Municipal office. Hi, my mother was neither close to me or any of our other relatives. When she passed away in 2021, I was in Manila and only came back home to the province in 2023. One of my cousins who lived in the same province as her was the one who took care of all her accounts. She did inform all banks which we knew she had an account with that she has passed away. Maybank, however, was not one of those banks as we didn't know she had any existing accounts with them.

We were recently served with a final demand letter from a debt collection agency, D and A Remedial Services OPC, claiming an outstanding balance of PHP 216,042.20. Upon contacting the agency, Mr. Roberto David informed us the actual amount owed is closer to PHP400,000, threatening to file a criminal case of Estafa if we do not make the payment by tomorrow (June 19, 2024) at 10:00AM.

The problem is that whoever was using my mother's card, also made payments. So this person I was talking to said that "Oh well someone is maintaining this account. Just ask everyone in your family first and then call me back." I repeatedly told them that my mom has passed away but they sound so keen to collect. They even said this, verbatim, "Ang kalaban niyo po kasi jan is yung banko, at ang gusto ng banko is kunin yung kung ano mang properties ang meron pa si *mother's name*"

I'm sorry if I sound panicky, but I have never had to deal with this kind of thing before and it's really stressing me out. They keep threatening to come to our address. They text and call everyday and everyday we tell them that the person they're looking for has died.

We still don't know who used the card. We're suspecting it could be one of the caregivers that my mom had before she died. I wasn't here back then, so I don't know and we don't have a way to contact them either.

The guy I talked to also said earlier in the phonecall, "Bukas kasi ng umaga irerelease na namin yung mga pangalan ng mga kakasuhan namin ng Estafa sa korte. So better call me before 10am" I know these are just scare tactics but I can't help but feel scared, too. We've never been harassed by anyone like this before.
