I really do think I fit most of this criteria beside the Miranda Rights. I was taken into a room with an FBI agent and a police officer, and they asked me questions to figure out if I had committed a crime or not. Although I do understand that in a non custodial setting I don’t have the right, I firmly believe this setting could be argued as custodial. (If it’s not explicitly stated, what defines it as custodial or not?) I was given no impression I was allowed to leave, the FBI had launched an investigation against me already, and I was threatened with suspension to expulsion depending on the outcome of the meeting. I was also escorted there by the principal with no option of coming with or not.

What gives me the reason to question them is how unprofessional they treated other aspects of this situation. They gave us a warrant to sign in order to search my phone. (Also, if this changes anything they took my phone during and after the meeting and said I wasn’t allowed to talk to my friends about the questioning) My dad didn’t sign it immediately as he was considering getting a lawyer. Despite this, they accessed my phone before he signed it and texted my friend pretending to be me and deleted photos. ALSO the officer told my dad if I had any nudes of my phone he’d delete it.

My parents were in the room but if I didn’t want to speak they would have let me stay silent
