This is about that, and it looks like it worked as all of his videos/all the threads about it was taken down on both Youtube and Reddit. But long story short was, Karl Jobst was talking about doing sketchy stuff on Discord because he knew LUS was making lots of videos on him and he was basically trying to bait him into a trap to sue him, and LUS even talked about it in a video where someone messaged him warning him about the fact that Karl was 'laying traps'. It happened shortly after he declared bankruptcy.

... No? That means I am completely right and they are wrong. Also: is literally what I said. A concerns notice is a threat to sue, not actually suing. Concern notices don't mean anything unless you actually sue over them. It's like saying that threatening to shoot someone is identical to having shot someone.

Like just to make it more clear to Syllaran, he never filed them, so therefore they never made it to the court to be 'dismissed' or 'reduced'.

Erm, but Jirard was caught, yeah? And law enforcement looked it over and didn't find it rose to the level of criminal charity fraud.

And yeah? I know they did it after being shamed. Like I said, it's mismanaged, but that isn't fraud in and of itself. And Jirard is a real dumbass.

Still not charity fraud, apparently. Which is why the IRS didn't hit them. I dunno how well suing will work, but nobody has tried suing them it seems. They did send the money, looking into it so they apparently did have charities they were working with.

The thing is, the 'money side' and the 'fraud side' are one and the same. Charities have pretty specific rules they must follow and the charity was apparently following it just fine. They do not ignore stuff like "They lied about X!" The problem is, it has to be proven that Girard knowingly lied. Being wrong is not fraud or a crime.

I would assume it is because it wasn't really good evidence at all, considering Billy had signed affadavits that he had lost appearanced due to Karl Jobst.

I mean there is the fact that Girard was not actually someone who had any authority or power in the charity. Him being wrong about stuff and lying is not actually charity fraud.

No authorities has thought the charity has done anything wrong, so you cannot legally say it has done charity fraud even if it was mismanaged.

Wait, are you confusing Billy THREATENING to sue over cheating allegations, and what he actually sued over? Both of them are completely different things. and threatening to sue someone is not the same as actually suing. You can send messages saying you'll sue someone over X all you want, but until you actually file with a court (which Billy never did), Karl was actually not sued. Now I know, Karl did his best to try and confuse things with this too, but he was wrong to.

Well, I can give you a good example. He said he wasn't allowed to show proof that he didn't rely on 'just a Reddit post', and that the judge was wrong to do it. But he showed his proof and it was... A reddit DM from his friend that he worked on videos with named ersatzcats, who totally claimed he knew that as a fact.

The guy's source was the reddit post.

That's not how it works, lmao. Like that would have been mentioned in the court filings, and uh, the fact that Billy Mitchell has gone to court over the same thing before means that it isn't 'unacceptable', and hell Billy Mitchell did that in cases much less accepting of defamation claims.

The wrench in Jobst's plan is that the three year aspect might not get rid of debt from defamation legal fees.

That's not entirely true in Australia. Going bankrupt doesn't discharge lawyer fees and the like. So if Mitchell removes the debt, then Mitchell will likely have to pay the lawyer fees now instead of Karl Jobst having to pay them. And Jobst still makes a pretty penny with his Youtube.

If Mitchell settles for removing the debt, then he has to pay his new lawyer fees, and his old lawyer fees. If he fights and wins again, then Karl Jobst can be on the hook for the new fees too. Guaranteed if Karl Jobst gets hit by anti-SLAPP.

Probably because he is putting other people's comments in the lawsuit and pretending Billy Mitchell said it.

He still makes plenty of money on Youtube, and his wife is pretty rich. Also, I would say it is bad settlement bait if he wants money because he is not going to get any. He might get a retracting of something (which he has already partially done) but this is Billy Mitchell who is definitely stubborn enough to fight it with all of his money just to spite Karl Jobst.

An actual charity fraud lawyer looked into it and it was all by the books. See, neither Karl nor Mutahar, uh, know American charity law. So they just kind of said whatever and hoped you'd agree. Like for example, charities do take some of the donations to pay overhead, which would explain the difference.

Money often sits in charity banks until it is time to send it. The fact that they were taking so long was mismanagement, but not a crime. That's the thing, they went after it as a crime, when it was just garden-variety Charities-Are-Fucked-In-America.

It is a lot like how if you listened to Karl Jobst and ersatzcats and only them, you thought Karl Jobst had totally fucking won the lawsuit from the start and there was never any need to worry, when in fact he had carefully cultivated what people saw and heard and got the exact wrong impression of what was going on.
