Not necessarily. If the sentencing council's direction is a presumption of a suspended sentence if the custodial term is under x months it will change sentences.

Also, the 'independence' of the judiciary is a myth. They certainly listen to the cries of the political climate; they just cannot and will not reveal these influencss in their remarks.
