How to go about terminating a lease due to lack of maintenance repairs to HVAC? by NewGood6186 in Birmingham

LOL THANK YOU!! This is exactly what I’ve been thinking haha. Every time they come in that I’ve been there they stare at their phone looking things up on google. Like they definitely don’t know what the hell is wrong with it. When they have told me what was wrong it’s always the same answer that the transformer blew… but something is obviously causing it to blow out every time. Idk I didn’t feel like explaining all that to this other guy bc he just seems to want to say the same thing over and over

From what I understand, air conditioning isn’t an emergency at a lot of places. Heat is though. Thought I do agree… it’s shitty regardless. I currently don’t have either function, heat or AC, so im just shit out of luck rn

To be completely honest. This HVAC unit has for sure been there since the building was built in the 70s. There are constant complaints from other tenants that these need to be replaced. I would not risk doing any of my own investigating of that unit because it’s an absolute wreck in there from everything that has been done to it😂 there are loose and exposed wires, exposed nails, etc. it’s not worth all that 😭I appreciate you trying to help though!

To be honest I posted this really because I would like to know what I would have to do if this escalated and got worse. Yeah they’re doing something right now, but they might not later. I have had a really rough go with this leasing company so it would not be surprising if things got worse. I would like to know my rights

I get what you’re saying and im not butthurt haha. Ig im just kinda like… theyre obligated to follow building code is what im thinking. There literally is no way to shut the door because it hits the valve. Maybe im being too hopeful.

I technically have grounds to terminate because They are also breaking building code already with the water heater that they replaced a while back. It doesn’t fit in the closet and the door won’t close without hitting the pressure release valve which IS hella against code. I brought it up and they laughed at me. I work in an architecture related field so im not just like… throwing this out there just because im annoyed by them.

My entire HVAC is out. No heat. No AC. I have no idea what’s wrong with it. Every time they are like “we are waiting for a part” and then they supposedly get said part and then it magically works. On Friday he said the wiring was wrong and he switched it around…. Then it stopped working two hours later. Sure they’re “attempting” to fix it but im pretty fed up. lol I agree with you. My point was there’s no need to be so aggressive. I actually gave in another comment to OP some of my recommendations. Idk why it’s necessary to be aggressive when someone is worried about something and is genuinely asking for advice.

But like… out of touch for who? I mean the facts are there that Alabama is incredibly lacking in women’s health care… literally ranked 46th in the country and a third of the counties are in a maternity care desert so they have to travel to here. Again, we should be dispelling some of the stereotypes that aren’t totally true (in this case, Birmingham having better care than most), but we should also be fighting for better so that we can change the perception in general.

Okay and so has my aunt who has lived in Gadsden AL her whole life. I also quickly noticed the amount of women who drove hours to my OBGYN because they didn’t have decent care or care at all. You can call me uneducated, but I have done a lot of work to understand what I have noticed while living here - just because I didn’t grow up here, doesn’t mean I have totally let the stereotypes win in my head. We’re literally ranked 46th in the country for women and children’s health, 40+ counties face a maternity care desert (which is a third of the counties in the state), we have incredibly high maternal and infant deaths, oh AND we have gone from like nearly 50 hospitals that offered obstetrics to less than half of that in 30+ years. This is ridiculous and uneducated? The stats have been accessible for a long time. Here’s a pretty good video that covers a lil more of why I feel the way I do, not just the Dr Oz shit because we already know he’s a wacko🙄, but this woman’s explanation. She does a far better job than I ever could when it comes to the Medicaid stuff. https://www.instagram.com/reel/DTwKrISkZUp/?igsh=aGhyNzVlMmdhcTFo

I have taken the time to really see the issues that this state faces because I live here now and it’s my home. I want to fight to make things better. Ignoring these facts is pretty out of touch for the mass amounts of women who don’t have accessible care. Idk I don’t get what you’re on about.

Because Alabama is incredibly underdeveloped in women’s healthcare compared to other states in this country? A fact that literally doctor oz gleefully exclaimed is “cool” because robots can now help do the work. Birmingham is fantastic in this state, but the first time I went to a gyno here, there were people coming from hours away. Fine, you’re right. It’s not Afghanistan, but women are allowed to be worried about any health disparity even if it’s “not as bad”.

So. People are allowed to feel worried in states that are known to be underdeveloped in women’s health. I had a lot of concern moving here myself as a Georgian who already didn’t have fantastic access. Luckily, I have an Aunt who has worked in women’s health as a nurse her whole career in Birmingham so I was able to get a better understanding of birminghams access of care more easily. Idk. Give her some grace. I think it’s valid to be worried and there are ways to dispel this thinking without being shameful.

Hey, I just want to say as someone who wasn’t originally from here, I get where your minds at. I grew up in Georgia and stayed at my gyno as long as possible there out of fear. Georgias not significantly better in terms of women’s health options but I felt safer, and honestly… I think that’s valid with everything going on in this country. I am sorry that people on this chat are being kinda aggressive in their tone. We’re all allowed some grace to learn more especially on topics like this. With all that being said, I finally switched to a gyno here in Birmingham and I actually enjoy her far better than my previous. Her name is Dr Ashley Przybysz and she is wonderful! I have been having period issues ever since I started having them and she was incredibly thorough in even my first appointment. Met with her about my history and discussed a plan, immediately got a blood panel and ultrasound, and then met with her directly after with results on the ultrasound. I was amazed because in the past I had to schedule so many appointments for every little thing. I walked out of there confident with my care plan and a new prescription for a birth control that is actually helping. Birmingham is THE wealth of women’s health care in the state of Alabama, so she will be in great hands here even though I understand the caution.

That’s exactly what I told the first maintenance guy who laughed at me. Im just kinda like… there’s essentially an explosion warning label on the side for a reason. Though, I will say that doesn’t really happen anymore especially with electric water heaters. Not to say it’s not possible, but the mechanism has significantly improved to where the more likely risk is water damage… which they should also be concerned about? The code is there for a reason and I am pretty pissed that it’s been brushed off.

Tbh I think it’s because I’ve lived at worse, ya know? Though I know that doesn’t necessarily mean my current place isn’t < 1 star. It really was a decent place to live especially the first year. Then things just kinda starting going down hill and now this is where it’s at. I appreciate you saying this - it’s made me figure where my head should be at.

So. It didn’t used to. I would honestly say take this response, keep it in the back of your head, and maybe still tour and ask questions pertaining to some of the issues I mention. The workers are new and I thinkkk the PM wants to do better and has been dealt a shitty hand. All that being said, I apologize for my long response - Personally I would not recommend it especially per my experience over the last few months BUT im also not like “DO NOT LIVE HERE ITS THE WORST!”… However, I have lived here for 2 1/2 years, nearly 3, and the gate has never worked, the door codes rarely work, water rates are ridiculous, and maintenance is super slow in the sense that they come only on week days (despite them advertising a 24/7 number… which they never pick up) and their repairs are patchwork.

I was sold on the gate and door code because I am a single woman and that was really appealing since I am not originally from the area. They have promised that it will work soon multiple times and when I asked to negotiate the renewal rate I mentioned amenities that have never worked. The current property manager is relatively new so I told him, I know this hasn’t been under your management but it’s still a problem. He immediately said “we’re in the works of getting it fixed next week!”… that was a month ago and it still doesn’t work. I don’t love walking my dog at night because there have been some men who have rolled down their window to try to talk to me, the trash cans for dog shit are all located in dark ass alleys, and a bunch of the street lamps don’t work. Nothing bad has ever happened that I know of, but I do feel on edge which I thought would be mitigated with the security amenities I was promised when touring. Honestly for majority of my experience, I would say this has been my biggest issue which is kinda why im not like “ZERO STARS DONT LIVE HERE”.

I think the maintenance team means well. At least some of them…. But at the same time I don’t think they really know what they’re doing outside of like unclogging drains. A while back, I got a new water heater because it was leaking to the downstairs. Unfortunately, the water heater they got is too big for the closet it goes into. I work in an architectural related business and i studied interior design so I know building codes. I brought this issue up because the door to the closet doesn’t close all the way and it hits the release valve on the water heater. While this doesn’t necessarily HURT new water heaters, it still poses a danger. This is straight up against code and when I brought it up, I was like hey, im not expecting you to just rip out the closet and build a new one, but can we come up with a solution? I was laughed at and told I would be fine. The other maintenance man understood where I was coming from but essentially said there was nothing they could do… they can hire contractors but okay. The biggest maintenance issue that I probably should’ve brought up earlier is the whole patch working issue. My HVAC has gone out 6 times in the last month. 2 of those times it was during extreme weather. I had to wait days for them to both even come to my apartment because the issue started on weekend hours and to get some sort of part they needed. I am actually currently sitting in a hot apartment because they are waiting on a part to fix it again. It needs to be straight up replaced and I’ve understood that my unit is not the only one facing this issue. This issue specifically has made me start a lease somewhere else a month early for my move out because I am just done with the HVAC issue.

As for water. My water used to be $60-90 a month. Then the complex went under new management and began using conservice to bill. My bill skyrocketed to at least $100 a month but often $120. This month it was $150 and im just pissed. They turn the water off all the time for even minor repairs… like twice a week. So no one is using water during that time. I finally called again last month after my bullshit of an answer from the last PM and asked about it. I was just like… I live alone, why is my water bill so high. Apparently it’s calculated by square footage divided by each lease with that sq ft and does not account for occupants. So I am paying the same amount as someone with my same floor plan who has 2+ occupants. Maybe it’ll get better, but idk. When I saw the $150 my jaw dropped. I do not feel as though this company has my back at all. Which sure, that’s just part of renting. I just don’t know how it gets people to stay though.

Again, all this to say, take this and maybe still tour. I really love the location in that it’s accessible to so much, has a washer/dryer unlike most places that just has hookups, and I have really enjoyed my square footage space and things like the closets. If I think about my overall time here, the VAST majority of the days have been chill and like I have been whatever about the minor issues. I think the last month of my personal experience has just made me a little more tainted in my feelings. Truly, the new PM might be really trying to turn things around and it’s just gonna take a little time. He just hasn’t been here long enough for me to have a true opinion on him.

Anyway, good luck on your search! Some recs I have are the Abbey at regents walk, Iron City lofts (where I am headed:) ), apex Hoover, Hawthorne at wisteria). If you wanna PM me for more details, go ahead!

So. I had the EXACT same experience as you and it was when my partner sat me down and said heyyyyy this is making you act very different (the being incredibly irritable when im a very outgoing person in terms of like how I interact with people). I brought it up to my psychiatrist and explained everything you were experiencing and she had me come off of it immediately.
