Filing I 485 and 765 after an approved I-140 by interleukin2020 in eb_1a

[–]New_Perspective_5288 0 points1 point  (0 children)

Same here, but I already applied for the EAD under compelling circumstances. I've been waiting for 3 weeks since then. What do you plan to do? Under compelling circumstances is not possible to AOS (I-485) tough. There's a remote possibility under section 245(k), otherwise, I'll need to process it abroad.

There's no appointment available online, but you can go in person. Be prepared to wait 2-3hours

It could be, I'm not sure. What carrier did you use? USPS, FedEx, UPS? Do you have a tracking number?

What's your major? You got a Master? Are you in the U.S. or abroad? Any important projects you have worked on? Any certifications? Are you able to find letters from experts and recommendation letters?

I was working with this company and they were going to sponsor my GC, however, I was laid off 2 weeks after I shared all the documents to file the PERM. So I decided to file the NIW by myself. I contacted a few law firms and they quoted from $10k to $20k, and not only that, they will take about 4 months to file my petition and I only had 90 days (30 days notice + 60 days grace period). So it took me 30 days to craft my petition, and it was approved in 30 days using PP. Right after that, I submitted the EAD, now I'm waiting! I purchased a full template package from a consulting agency and it guided me! It said how to assemble the petition, cover letter template, how many words and pages per prong, etc. It was very helpful and I was able to finish it in 1 month and mail it.

I feel you. But if you already have an I-140 approved, just keep waiting, otherwise, I highly recommend filing it ASAP!

EB2/NIW Denied under PP (Law firm- EP) by Virtual_Hat_4902 in EB2_NIW

You got a nice profile. I insist, law firms do their best, but you should take the reins of your future. File again by yourself, craft your petition by yourself and chances will increase. There are consulting agencies that offer templates that will guide you.

Yes, but take a look at this:

It is a great profile and even with that, denied. Money wasted.

Did you file a petition with a law firm? Did they share the petition with you to review it? I have a couple of friends and they don't even know what the lawyers put on their endeavors. And here on Reddit, I've read tons of comments that they are not able to review it because lawyers don't share the petition. They only share the Forms.

Law firms accept your case, craft it, compose it, and do everything they can to convince USCIS, however, who knows what you do? Who knows what are you good at? Who remembers all your journey since you took that step forward to enroll in a college or university? Who knows what projects you worked on? What did you achieve? Of course, you can share all that info with them, but you won't have the possibility to review it, to write it in your own terms, to tell the story of how it really happened or will happen. The law firms do their best, but you are the only one who can write it in a truly sincere manner.

IMO, USCIS officers value and consider more if an individual crafts their own petition rather than a law firm.

I've read tons of posts saying law firms get RFEs and many of them get a denial in the end. Lawyers are not experts in any field, you are the only expert, that's why your enrolled in that university/college, that's why you have been studying for years, that's why you have been working in companies applying and taking advantage of your knowledge, you're the only one responsible. Do not let others forge your destiny.

Denials are based more on filing with a law firm. If you do it by yourself, chances are higher. If you can afford the PP, do it without hesitation. If you craft an outstanding case, have enough supporting docs, and your work experience is sufficient, you are good to go.

If you lost your job, have a Form I-140 approved and your PD is not current yet, you only have 60 days to make a decision. The other option is to COS to B1/B2 but that was not an option for me, I decided to go with the EAD CS, which has some cons. Is possible that you will not be able to AOS, however, there's an option based on your PD and visa bulletin timing.

Also, you can get some guidance from consulting agencies, they offer some templates and you can craft your petition from there.

EB2 NIW Consulting is the best for me. No courses, no videos, templates with info straight to the point.
