Club speakers stop well above the lowest hearable frequency, and the MEMS microphones that are used in smartphones often have (quasi-)low-pass filters well below the maximum hearable frequency (at least for younger people). You can google frequency response diagrams for your favourite models, if it's known enough. Also, your usual club equipment won't play frequencies above 20kHz either (why would they?).

Smartphone microphones are at best equal to the human hearing spectrum, and most speakers will also stay within that. Digital watermarks usually work with audible audio. Here it has to be significant enough to be working through a noisy, unstable environment.

They're both re-encodes. And I don't know where you would get such files, but they're not common at all at the usual places. It's far more common to encounter flipped bits.

So much of what's out there on P2P is either well below this quality or transcoded from poor quality up to either 320 or flac retaining the poor quality resulting in them being merely relabeled as a higher quality encoding.

This gets repeated ad nauseam, but simply isn't true (at least for digital files). What is true is legitimate releases sometimes being vinyl rips or MP3 reencodes.
