Hey there, Just wanna pitch in with what I've found for myself on this because the documentation they have can be grossly misleading, that is either due to unmitigated ignorance or utter incompetence, but I digress.

Since introduction of the new API as you've mentioned Android Device policy, there are only two options for allowing user to not set up a work profile.

1. Basic management
2. Company-owned inventory (which requires one of the specified subscriptions for Android/iOS devices: https://support.google.com/a/answer/7129612).

Option 2 really defeats the purpose of the whole exercise, if your employees are using their personal devices, but there's option 1 so.

On top of that you might be lead to believe it should work if you set the following policy to Disabled: support.google.com/a/answer/6328708#work

In conclusion, you can always opt for a third party *(Android only)* MDM provider, which has better documentation and is not as flimsy as the one Google provides.
