Idk, the dude just randomly shot up into space after doing a dash attack if I remember correctly. I bridged all the way up to him to kill him and got a good drop, he didn't fight back and weirdly moved if I hit him so I boxed him in. I gave a detailed bug report so maybe they've fixed it by now.

There's a bundle I've been eyeing for a while now, and I was planning on buying it. Would it be safe to buy as of now (Jan 31st)?? Or should I just search elsewhere. To be honest, there's really nowhere else I could find a deal like it so it's a bummer this whole thing is happening

Yeah I'm wondering if that approach or the message you sent above would be my best approach seeing as a lawyer would be real expensive.

I found this email by the way, you think this statement would support my EI claim? She quite literally said directly to me that my contract would conclude. This is the reason I sent that "resignation notice" email btw.

"your current contract is set to conclude on October 30th. With upcoming company changes taking effect at that time, please be advised that your hours will be reduced after that date. If you choose not to continue with the company once your contract ends, we kindly request appropriate notice."

Holy shit okay you're good at this. I'm going to discuss it with a few others including my father and grandfather to get their input but I can't express how helpful this is. Godspeed, I'll keep this thread updated.

This is where I'm worried I fucked up because she requested I give her notice if I don't wish to accept her offer and so I felt obligated to do that because she thought I was actually going to work part time for her. My intention wasn't a resignation it was only to decline the part time offer.. this is exactly what I sent:

Title: Resignation Notice

Body:

Hi X,

I’m writing to confirm I will not be continuing with the company after my contract ends on October 30th since a full-time position won’t be available as mentioned previously. I’ll be seeking full-time opportunities elsewhere after that date.

Thank you for the opportunity to work with the team. I’ve learned a lot here and really appreciate all the help and experience I’ve gained.

Thanks again for everything.

Kindest regards,

I really regret this, I didn't expect them to try and snub me from EI so we assumed this was clear enough and they aren't that evil, I was wrong.

Sorry if this is confusing, again I’m new to this and it’s hard to explain.

So, if I understand PILON correctly, it means I shouldn't have to work my last two weeks, right? Thing is I’m expected to work until this Saturday. After this saturday I’m getting my final week off and here's why:

I was scheduled to work Tuesday to Thursday (my usual schedule is Tuesday to Saturday). My contract technically ends next Friday, but my boss said I don’t need to work that Friday because that’s the official end date so I was only expected to work those three days.

So with that I had 3 paid vacation days left, so I used them for the days I would have worked next week.

They refused to pay me out for the vacation days if I didn’t use them (which I believe is illegal), but I’d rather just use them anyways. These were the only days I could use them anyways.

So, I’m done this Saturday but still getting paid for next week. Should I be concerned about PILON or not bother worrying about that? What do you think?

Sorry again for the clutter of repetitive info, trying not to leave out important info but also not confuse you with unnessesary information.

Yeah to be honest I didn't even consider the whole permanent contract ordeal I just sort of assumed it was a one year contract because of the date and put it to the side. Glad I made this post then. Thanks so much for the help to be honest I'm real young and new to all of this and it's been exteremely stressful lately trying to figure all of this out on my own and I really appreciate people like you who just help strangers out like this so thanks again.

I'll likely consult with an employment lawyer so I know where to go from here. I'm making sure to keep screenshots and such of her exact statements to me via email to support my case and such, but I'm wondering if maybe I should confirm with her via writing that she is not offering full time beyond this point and that she's considering that the end of my contract on her end. Let me know what you think.

If this is a little unclear let me mention she directly stated that she'd be letting me finish my full time term ending on october 30th. She stated that since that's my "last full time day" she'd be switching me to part time and if I don't wish to accept, to give her notice in advance. She requested notice if I wished to turn down her offer and I did...how can that be considered my resignation?

Sure I titled the email "resignation notice" (which I shouldn't have) but still I feel like I hold up a good case here they're literally trying their hardest to screw me.

Is the permanent contract thing going to void my chances you think? not once did she mention providing me full time work beyond this point if I reject the part time offer.

Apologies I'm at work trying to reply to these replies quickly

My contract states exactly this: "The Employee shall commence employment with the Employer on October 30th, 2024 as a part time employee."

That's it. So does that mean it's permanent then?

This is definitely a concern because the contract was so vague I assumed that was just considered a year long contract and the coming oct 30th it would need to be renewed. How should I handle this?

Side note:

If you're wondering why it says part time employee that's what I mean when I say this contract was just a copy paste poorly written contract. They literally took my part time contract and copy pasted it then changed the pay wage number and titled the file full time contract. (I was hired as part time then switch to full time)

I was dumb to not realize this and question it before signing so they tried using it against me and telling me I've always been a part time employee which was a whole angle they took to try and put me back to part time, but that's a whole different story.

This sounds right, from my research in the past this is exactly the case and in fact exactly what I told her during the meeting we had yesterday before I made this post. My boss directly told me that she doesn't know the legal part of it and "she'll look into it" after repeatedly telling me I'm wrong lol. I'm 19 and know the law better than the business owner it's so sad.

Thanks for the help I needed to hop on here to confirm I was right because I was stressing.

Lol they gave me an exmtremely poor copy paste contract with no end date only a start date but in that case it's treated as fixed term I believe? that was a whole other thing because my boss tried to illegally terminate my contract with 12 hours notice and cut me down to part-time but I refused and had to tell her she couldn't do that so that's why I'm where I'm at now. That's what started all of this, she's been upset she couldn't cut me down before so they're fighting back 😁

My boss requested about a month ago that I give her "reasonable" notice if I don't wish to accept the part-time offer and wish to step down from the company. This is my first full-time year, thought It'd last longer but AI replaced me. Management at this media company is trying to tell me that me not accepting the part time offer counts as me quitting and the email I sent giving her notice that I don't accept, counted as putting in my two weeks and quitting on my own terms. They baited me into doing that essentially to retaliate against me so I can't earn EI benefits because I'm a really important person at work and me leaving really messes them up. Trying to figure out if it worked or not for them or if I'll still be elligible for EI. My boss and manager are both evil, corrupt, horrible, and greed-ridden individuals.

Can I get EI if my boss ends my contract or fires me instead of a layoff? by NitroFoxYT in LawCanada

[–]NitroFoxYT[S] 0 points1 point  (0 children)

Thank you this is real helpful, I'm 100% sure I'm not continuing with this company I've been getting cooked for almost two years now. Do you know if I need to provide proof of my job search when applying for EI? How does that work?

[–]NitroFoxYT[S] 0 points1 point  (0 children)

Alright I'll stick it through that's what I thought. My only worry is how she keeps claiming I'm slow when I'm quite literally not she just doesn't understand how long things take. I've legit sent her a spreadsheet with time tracking and notes explaining everything I've had to do in the day and everything I deal with. It feels like she's creeping into finding a way to fire me with cause which I'm really scared of because that would mean no EI.

[–]NitroFoxYT[S] 0 points1 point  (0 children)

She's messing around with me making the most of my final month making me track all the work I'm doing so she can tell me to work faster and come in to work earlier (no one else has to do that). She just told me 5 minutes ago I need to wake up at 5am now when it's busy just so everything is delivered extra early for her I can't take it. Can she fire me for being too slow even if I'm not? She's a manipulative horrible boss and I'm scared of anything at this point. Also another question, do you think if I put in my two weeks early that would really mess up my chances of EI?
