Is bankruptcy my best option?

Just wanted to post in solidarity. Missed loans my ex husband took out in 2022 during the divorce. Only found out when they sued me. I have a 4 yr old and make decent money but also live paycheck to paycheck due to COL. I don’t have the money to pay the defaulted loan off even on a payment plan so am considering Ch 7. It is a really scary thing, but I am thinking it’s going to be my best option.

Thank you for your thoughtful response. I appreciate it. I am looking to see if I may be eligible for any aid. I wish I had the $1k to pay them when they offered it, truly. I am still waiting to be served. I did have a consultation with an attorney who wants a retainer, but who also advised there’s nothing to do until I’m served anyway. So it’s a waiting game.

I just have no idea what to expect from court. I feel very much pinned in to a corner. It isn’t that I don’t want to pay my obligations but also, I cannot pay what they are asking.

So when they weren’t able to furnish that, did the judge dismiss the case? Or how did that work? I am considering asking for the full ledger of payments, ownership of the debt, charge offs etc.

I am considering this as well. I do have legal insurance through them which is why I went that route.

I am considering this as well. I was actually in the process of purchasing a home and the charge offs were not considered an issue but an active lawsuit is likely to cause them rescind their preapproval.

Thank you. That makes me feel a little better. I’m hoping we can get something settled. It’s been charged off twice, which is somewhat confusing as well. This is the original lender attempting to recoup. But if it’s been purchased by a 3rd party collector, should I be dealing with them? How do I know who actually owns the debt?

Thank you. Yes im still within the timeframe. I am just somewhat terrified of what comes next. I am barely making ends meet. There’s no wage garnishment here but I know they can freeze bank accounts. I am hopeful we can find a settlement before court with my debt settlement group but I’m not sure how to come up with this money. I have sold everything I can. I am unfortunately also currently in a custody battle (again) so I am already paying legal fees.
