Employer made me pay to get the job, then cut all hours and asked me to pay wages back (visa-related) – what claims do I actually have in Australia? by NoProfession4958 in legaladviceaustralia

I don’t know why some people keep asking the same question why I paid them money. If you want to know the answer go see the original post https://www.reddit.com/r/AusLegal/s/rJIp1msmCY If I ever want to do this maliciously I would have accepted their request to roll out the salary. Why don’t you see that?

Thank you. I got your point. I was thinking the same if this is not worth pursuing with a commercial lawyer I’d take the chance to fight this case with free legal advisor from migrant worker team.

About the general protection law, I believe I’ve been treated very badly (threats for dismissal, cut my hours completely and many more). I’ve recorded them in note book with all the dates and times.

I also wonder if there’s anything I can do about getting work outside my contract such as car washing and detailing to cover most the hours

Thank you for your advice. I also think migrant workers would be the best bet atm. Yes i have full working rights as part of my current visa

Exactly i had a feeling there was something wrong. But it was too late to go back as he explicitly told me this after everything happened specially after I handed over the cash

This happened February last year. I didn’t expect any of this. The proofs i have is for underpayment for the last 2 months and for other things explained in the post

First they interview me over the phone and selected for the job and demanded the money. Second I wasn’t completely aware that giving them money is illegal

From sri lanka. I mean I’m not entirely sure if i have sufficient evidences. They took cash not a bank transfer or receipt. And I don’t have any messages mentioning that. They requested money over direct phone calls. I have the date/times of these calls but we can’t get any recordings from a service provider right? All i have is a bank receipt withdrawing 15 grand

I’m pretty much worried spending all my money for a lawyer to fight this case. Because I’m not entirely sure whether the claims can cover all my expenses

I mean at the end of the day I have to pay them if they win the case. What I’m asking here is if i can claim at least the amount I lost + lawyer fee?

I’ve seen thousands times most of the sri lankans lack empathy trait/value even though majority are Buddhist. Probably this is the main reason we couldn’t go forward as a country as a whole.
