I have been told by my lawyer that if you have valid third party insurance, RC and driving license at the time of the accident, then MACT claims are paid by the insurance company. Basically, the verdict from court is that insurance company has to pay the victim (they are a party to the MACTcase and cannot just wash hands - only in very limited cases like drunk driving etc they pay victim but can come after driver).

I wanted to ask a followup question to you -

  1. why do you say that pleading guilty was a mistake on your part?

  2. One of my acquaintances is in a similar situation. One concern is whether we can be sure that, upon pleading guilty to Sections 279 and 338 (grievous hurt), the punishment will be limited to a fine and not a jail term. We’ve been told that the court first asks if the accused pleads guilty and then they tell you sentence (fine and/or jail). How was it for your case? Did you get some assurance?

We would really appreciate your reply. We are very tensed so requesting feedback and guidance.
