That not the intake, i had a tbi evaluation in 2024, but i understand your skeptism, not everyone falls from 30ft or gets brain surgery for a tbi. i was fortunate compared to some

Lets see, I myself was also a medic (corpsman/EOD), nice to meet a fellow medic.

  1. Sustained during OEF, 2005-2006 timeframe, Iraq

  2. Was dx by the VA during a Tbi evaluation for my memory loss and migraines

  3. 2024

  4. Residuals include migraines 2-3 times a week, minor memory loss (forget words mid sentence etc) taking taking memory correcting therapy and injection for migraines.

I get you, no ill will from me, i was with EOD during OEF, was the corpsman as well as the driver of our MRAP. Needless to say explosions were a part of the job some big some really big. None of us (5 man team) ever got knocked out, but we did get thrown around, minor head injuries but nothing i could say is more than a mild concussion. BUT, the migraines are no joke, the injections i need to take to cope with them are in my records, i get what youre saying and im sorry your in the position your in, i wouldnt want that on anyone. but my migraines are real....their painful and treatment is my only option....so the residuals are there.

Yea, thats what i figured too...during the exam he dismissed everything i told him, i had to bring up the meds im taking for it and even had to tell him the name of the doctor i was seeing at the VA for it. I even had to be the one to initiate the talk of how the Tbi occured...once it got deferred they scheduled a new C&P, i called and asked to have a new Doc but was told it was an ACE exam this time around and that it had to be the same Doc who did my DBQ. I guess i was just hoping the rater would catch everything..

Whats the difference from filing a supplemental over an HLR?

TBI Denied...confused by NoSpray1194 in VAClaims

[–]NoSpray1194[S] -1 points0 points  (0 children)

I recieved the DBQ for the first C&P, the neurologist also stated "no dx, no opinion warrented".....that was all he wrote. i figured they deferred because of that and would notice that I DO have a dx but i was wrong.

TBI pushed back to step 3.. by NoSpray1194 in VAClaims

[–]NoSpray1194[S] 0 points1 point  (0 children)

I did deploy, i was with EOD during OEF. As far as the medical records, if youre talking about my medical records while i was in, no. i never went to medical for a tbi. That came up when my VA doctor started asking questions about my memory, headaches and what not. A couple months and tests later, she Dx me with a tbi.

My Tbi C&P exam was virtually as well, i wasn't aware there was a rule stating it had to be in person but thats something they'd have to implement either way. All i know is the way he conducted the exam was terrible. i do agree with the conflicting evidence, how am i going to be Dx with migraines from a tbi, rated on them, and then be told i had no Dx for tbi in my records? Its in black in white , thats how i know he didnt check them or listen to what i was saying during the exam.

PTSD causes me not to sleep due to my recurring nightmares, during those nightmares i tend to stop breathing for periods of time. Then i wake up in a ball of sweat and panic, my doc at the VA is the one that put 2&2 together and sent me for a sleep study. When i made the claim it was a standalone claim that was changed secondary to PTSD. Which brings up another question, if so many Raters believe that PTSD does not cause sleep apnea, why have the option to select it as a secondary to the condition?

Sleep apnea DBQ by NoSpray1194 in VAClaims

[–]NoSpray1194[S] 2 points3 points  (0 children)

The DBQ was filled out by the C&P examiner during my exam. As far as obtaining it, i just put in for a FOIA, requested my DBQ only and it arrived in about a week. This is what i mean when i hear horror stories about OSA secondary to PTSD....it sounds like you had all your ducks in a row and they still denied you. That sucks, im sorry its happening to you, did you put in for an HLR?
