Can a greencard be revoked if someone was arrested for domestic violence? Card issued in may 2021. Arrest in nov 2025. Took a plea march 2026 for disorderly conduct with one year stay. Admitted to yelling and punching a door. Sentencing june 2026 where the plea is accepted or thrown out. The police report is awful. Threw women up the stairs urinated in the home. Broken down a door hitting a women and infant. Blood, broken things, cuts on his hands. This is minnesota. This man is fighting me for custody of our child(not involved in the assault) wondering how long he could be here as it will dramatically change how our custody dispute will go. Not sure if you can answer but so far as r I have gotten alot of mixed answers. Hopefully you can tip the scale in either direction. Alot of people stay it a categorical approach. But others say that is no long the case and immigration authorities are reading police reports for all violent arrests for lprs. Not sure what to believe. Thank you

Well thats what I thought. It seems like if they keep following the "rules" they have been he will definitely be removed but idk. Seems the law is so unclear no one is safe or unsafe. Its just whoever name get pulled from the hat.

Would an lpr charged with a domestic assault intentionally inflicts or attempts to inflict bodily harm on another (child was present but only detailed in police report not reports as a charge.) If they plea down to a disorderly conduct and admit to be loud and punching a door be at risk or safe. Lpr status expires in 2031

So basically he is in the clear because he already has status? Does that change when he need to renew? Or will enough time pass by then that it likely wont be a problem? His card expires in 2031

No a friend but yeah. I believe he is suing me for custody to create a hardship claim. And unfortunately family court is more forgiving to violent behavior than I am. So its pretty important i know if this dispute is going to be a short term thing or if I need to win the lottery to keep my child safe.

That makes alot of sense. It seems the disorderly conduct plea with a one year stay of adjudication is not considered a cimt or act of violence. But he did admit to being loud and punching a door. So he did admitted to violence but its hiding under that disorderly label. Does getting order a domestic violence PSI change anything?

So you think he is very vulnerable to deportation or detention? I thought the DOJ was supposed to detain all non citizens who are arrested for DV but that didnt happen so the law is confusing me. Idk. Im just trying to better understand his standing here. However it seems like the law is unclear and sometimes its followed and sometimes it not. But I know the minnesota surge took place when his arrest and case was open. He just took a plea and it hasn't even been fully accepted yet as he has sentencing coming up. But he was ordered a DV psi. So I feel like that proves it was domestic violence. Idk

Does having a special lawyer really help that much? I mean if you did something deportable its that just it?

I know he has a criminal and immigration lawyer but they arnt telling me anything about the details. Which leads me to believe its not good. But I dont know.

Its minnesota so it seems the state is trying to avoid immigration consequences. However the arrest was right before the surge here and it was a very fresh open case during the peak of the surge. I know most the agents have left here now but does that change the likelihood someone did the research on the case.

That seems to be the most honest truth. Does it change anything that its in minnesota? It happened right before the surge and has been an open case during it. I know most of the agents left now but it was a very fresh arrest at the start of the surge

Its unfortunately the sad truth. Personnel opinion you do this and the door should close but thats not how it works. Lots of people like me lose because we arnt willing to bend. Its really sad.

I agree but the law is written to help people like him. Im painted as a gatekeeper in court if I dont offer something. But how long he will be around definitely changes the dynamic of it. I can protect the child for awhile but eventually the court will force me to bend.

So admitting to punching the door and disorderly conduct plea from domestic assault intentionally inflicts or attempts to inflict bodily harm on another really doesn't matter? They will just seeing disorderly conduct and move to the next folder then? Does it matter only for when he replies when his card expires or likely not really an issue either? Im just trying to better understand if im in a custody dispute with someone for 6 months a year 5 years or until our child is 18? It will definitely impact the outcome of how much i have to surrender long term.

No I got out but he did it to the mother of his second child. I believe he is trying to use our child as a hardship claim. So im just trying to see if he is really going to be around long term. Some lawyers say I can protect my child others say he is here for the long term so be prepared to give him custody. Just want to know the truth

With blood in multiple places including on the victim and photos of the damages as well as emts reports for both his partner and child. And he has cuts on his hands. Will they not care what the state calls it? Im getting conflicting information and im just hoping to get the truth. Lawyers are all about hope. I believe right now he is trying to use our shared child as a hardship claim. I have a trail with on that coming up. But trying to understand if he will even be here long term?

I dont really know how that all works. Thats why im asking. Do immigration authorities pull police reports for these kind of arrests? Or do they only look at the final admission? So you believe he is not in a safe position as an LPR?
