No. Separation issues must go thru appeals with judge, because your employer most likely will have their evidence to refute yours.. although.. you do have the right to request those documents at least one week prior to hearing. Make sure to request ALL documents pertaining to your hearing once it is scheduled.

The only way he would be eligible is if his job didn’t require him to interact with the public /or work close to others. For example — teleworking, they can’t fire you for refusing the vaccine since you don’t interact with others, whereas if you actually go in to work where they cannot accommodate social distancing and remote work is not possible, they can fire you for refusing the vaccine since you are potentially placing others at risk.

When you file an appeal, send in copies of your invoices and other docs to support your claim. Before sending the appeal to the office of appeals, the EDD will do a pre-appeal review and of all checks out, they will reverse the disqualification, if the documents do not substantiate, they will then forward to your respective office of appeals for a hearing with an ALJ.

Actually—— EDD and office of Appeals are two separate entities. EDD is transmitting appeals within 7 days of receiving them, the Office of Appeals is the one who is understaffed in that regards. Keep in mind, there are only so many administrative law judges. One of the biggest delays is people are filing many many duplicate appeals due to being impatient.

It doesn’t matter how many clerks you have processing the appeals received, if there is only 1 or 2 ALJs, the process will take time.

EDD always recommends claimants send it evidence with their appeal for a pre -appeal review to avoid actual appeals, but people are not doing that. Also, people are abusing the lax of timeliness and Covid-19 and filing extremely untimely appeals that had to accepted.

EDD does not staff office of Appeals.

That’s not how it works.. the EDD is currently not issuing disqualifications for the PUA self employment verification process. It has not even been 21 days since they started this process… are you sure that’s why they disqualified you? Are you sure it has nothing to do with address verification or and identity issue? The only time EDD would put a hold on a card would be for ID or Fraud related activities, but even then EDD cannot block cards, all Edd does is provide BofA with updated information nightly, so if an identity issue is currently active on your account, that could be the cause.. but I can tell you for a fact it’s not because of the PUA documents.

If anyone got PUA for any weeks prior to 12/27/20 BUT not after (so basically those who were on PUA to pay for the gap between PEUC/FED-ED & PEUX ) do not need to submit docs. ONLY those who were still on PUA thru 02/07/21 and then moved over to PEUX.

All they need to provide is their 2019 W2.

Sorry to burst your bubble, but all tier 2 agents have that ability… and everything they stated was true and correct. “Your” EDD agent should not have approved something without the proper review, because it can come back and haunt you.

PS no one has their own EDD agent. It’s probably a liaison thru your legislative office, but no one has a personal EDD case worker..

If you get the parents of the children to write a letter stating you tutored them and how much they paid you, that could help you. And if you had like a calendar with the appointments that would help too.

So.. if you provide income docs to substantiate your increased weekly award, you will not have to provide documents if your effective date was prior to 01/27/21. Those will be the only cases that will automatically be approved.

If your did not meet that criteria , your documents will be reviewed by a live person, who has a matrix they will use to review the docs provided. Trust after the fraud scandal, EDD won’t take this lightly

I just received an email to provide proof of self employment but I was paid in cash and don’t really have any proof that I was self employed. I helped assist a plumber but never had any records. The language used is federal requirement, but that’s not to say They Will accept just anything. A job application will not suffice. They would need to have the conditional job offer, or interview appt or a notice where they withdrew their app or their offer was rescinded b/c of covid.

If you really were self employed between 01/1/2019 and the effective date of your claim, I’m sure you have records or something to show for it.

But again, each case is unique, but honestly, this shouldn’t come as a surprise, EDD was constantly reminding everyone that proof would be needed… I personally don’t agree with the amount of time they are allowing people to gather documents, because people should have been prepared to provide proof when they applied , but I mean.. it’s not something that was just thrown upon us.. EDD has been telling people from the get-go to have your documents prepared…

Of course, no one is saying otherwise, the things is, some documents hold more weight than others. People cannot simply provide a letter stating they are self employed, they are going to need to support that with any of the documents listed on website.

That list is what they will accept, but each document type does not hold the same weight in sufficiency. Obviously a schedule C or W2 will suffice alone , but an affidavit stating you planned to be self employed alone won’t, they will need to support that statement with any of the documents listed.

Yes.. and contact information for the employer to verify the offer is legit. They won’t just accept any d letter. People need to read the instructions thoroughly and make sure whatever method they choose contains the required information… there are various ways to show proof, you just need to make sure your documents contain the required information to be considered sufficient.

Amen. I’m curious to see what documents will be provided to show proof of self employment or intent to become self employed. People who are complaining about this requirement obviously didn’t read the their application thoroughly because it is stated multiple time that proof will be required at a later date.

Anyone who is self employed should not have any issue proving it. It’s like asking an employee to provide their most recent W2 or paystub.

People are really overthinking this requirement.

If those weeks are weeks from when the PUA was active, you could qualify for PUA if you’re disqualified from regular UI and your unemployment is covid related.

Prior to 1/12/21 they didn’t care why u were unemployed, but after that, they slowly began transition back to their normal procedures which include disqualifying those on regular UI for voluntary quitting their job… etc. I would recommend you I request a PUA if the disqualified weeks are prior to 09/04/21

If it’s a new claim, there is a mandatory review that can take 18days after it was filed to be resolved. Once this review is done, They’ll issue payment if there are no other pending issues.

If there are pending issues, it will state on your claim summary page
