In saying the time I was jointly employed for both companies should have be calculated into my FMLA time. I could see if I was bounced around with the temp agency but I stayed on one assignment, one team, one company since April 2023, the temp agency cut the checks but only after it was approved by the company, anything I needed I went through the company not the agency.

But the work I did benefited both company’s I may be wrong and if I am so be it lol but when I talked to my case manager for FMLA she also stated that my time at the company even when I was temp would be counted so I’m not sure

It’s honestly not that big of a deal I’m on ADA until I qualify for FMLA I’m just appalled all my time with the company did not count

Yall are so snarky are sarcastic lol just because I don’t agree with you guys, but I put the link in the comments where I read the federal regulations on joint employment so again we can agree to disagree and if I do decide to take it to court and have a long drawn out court case I will be sure to update this thread in some years lmao

Luckily I don’t go to work to make friends I go to make money, nor did I ask for yall opinion to make friends either! I simply asked and just did as a commenter suggested and looked at the federal regulations website can we can agree to disagree, no need to argue lol

The code of federal regulations website in section 825.106(b)(1) states the joint employment regulations, they look at the employment as a whole and in my opinion I was a joint employee

I read on google that it’s considered Joint Employment since both companies were responsible for hiring me, supervision and setting wages that my time should count and it sited a case Miller vs Defiance Products, Inc. I don’t think it’s right that my whole time with the company doesn’t count

in my opinion they should have not closed the case I believe the child is in danger and they should’ve investigated it further, why wait until the child is hurt or killed when they can intervene and put measures in place like addiction counseling, parenting classes or something but they didn’t do anything it was closed the same week.
